Eagle eyed mediators may have spotted the further update to the Civil Procedure Rules this week. The changes that were made immediately following the case of Churchill were to add the power for the court to order or encourage parties to engage in dispute resolution. This has already been added in to the overriding objective and to Parts 28 and 29 of the CPR, which concern Fast Track, Intermediate Track and Multi Track cases. The new set of changes adds the power for the court to order or encourage parties to engage in dispute resolution in to Parts 58 and 59 of the CPR, which concern the Commercial Court and the Circuit Commercial Courts respectively. These changes explicitly confirm the impact of Churchill for commercial disputes. The Lady Chief Justice delivered a significant speech to the BIICL (British Institute of International and Comparative Law) this week, highlighting the evolving role of mediation in dispute resolution in light of the Singapore Convention. Emphasising the importance of the rule of law, she discussed the potential for the Singapore Convention to enhance global legal frameworks while fostering cooperation between litigation, arbitration, and mediation. Her insights reinforce the need for legal advancements to meet the demands of an increasingly interconnected world. Kelly Stricklin-Coutinho, Chair of the Civil Mediation Council, commented: "Mediation working together with litigation and arbitration is essential to supporting the full development of England and Wales as a leading global centre for dispute resolution. It will lead to better outcomes for parties to those disputes, both domestically and internationally." In her lecture Lady Justice Carr highlighted how the CMC and other bodies are already performing essential functions, such as maintaining professional and ethical standards for mediators. She also suggested that its scope might need to be broadened to align with the growing demands of international mediation. Did you know that the Civil Mediation Council has a Working Group for Peer Mediation? Established just two years ago, it now includes 59 members dedicated to delivering Peer Mediation training in schools. At the January meeting, members shared ideas, celebrated the winner of the Peer Mediation Award at The National Mediation Awards 2024, and discussed the ongoing National Evaluation Project. Together, they are working to expand the reach of peer mediation in schools across the UK. The CMC Workplace Mediation Working Group met in early January to discuss initiatives for 2025. Advocating for mediation within Local Authorities was a key item and the group are planning an event this Spring to look at how mediation can support councils with employee relations and more widely. Working in Partnership with Acas, the CIPD and other key stakeholders, the group are using their remit to influence how organisations approach disputes in the workplace. The group will be arranging a round table discussion later this year to look at topics to include the grievance process, the impact of upcoming employment legislation and how early resolution of disputes can be better embedded into workplace culture. Our thanks to all those who are volunteering their time with this group led by Dionne Dury and Camilla Palmer KC (Hon). With backlogs at the employment tribunal resulting a two year wait for a tribunal hearing in some cases, mediation can support prevention and resolution of disputes meaning that for many the cost and misery of litigation can be avoided. #workplace #employment #mediation #workinggroup #initiative #agenda #support #volunteers
