The recent Court of Appeal decision in Khan v D’Aubigny [2025] highlights the importance of correctly serving prescribed documents when relying on a Section 21 notice. The case examined whether key documents, including the Gas Safety Certificate and How to Rent booklet, had been validly given and explored the definition of a “notice” in tenancy agreements. The ruling reinforces that landlords must keep clear records of service, while tenants disputing receipt need credible evidence. The Class MA permitted development right offers a streamlined route for office-to-residential conversions without the need for planning permission, but a recent planning appeal dismissal highlights key considerations for developers contemplating utilising this right Adverse impacts relating to issues such as transport, parking requirements and fire safety compliance can lead to refusal if not properly addressed.
