From 26 October 2024, all employers (irrespective of size) will be under a mandatory duty to take reasonable steps to prevent sexual harassment in the workplace (the Duty under the Worker Protection (Amendment of Equality Act 2010) Act 2023). The Duty requires employers to take active steps to prevent sexual harassment in the workplace before it happens, including harassment by third parties such as clients and customers. In this Ten-Minute Talk, Partners Emma Bartlett and Beth Hale discuss the following: ✅ A proactive approach: The focus on employers taking proactive measures to prevent sexual harassment, including conducting tailored risk assessments that are specific to their business and its employees ✅ Practical guidance for employers: Ensuring policies are updated and specific training for employees is provided, ensuring effective mechanisms for reporting and challenging inappropriate behaviour and responding to incidents ✅ Workplace events and alcohol: Addressing risks at workplace events, particularly those involving alcohol, and the importance of encouraging responsible drinking practices ✅ Third-party considerations: The need to ensure that third parties, including clients and contractors, are also compliant with anti-sexual harassment policies and how employers can be braver about taking action against third parties where necessary #SexualHarassment #WorkplaceSafety #EmploymentLaw #UKEmpLaw #EmployerDuties

In celebration of Black History Month 2024, Partner Emma Bartlett and Senior Associate Wonu Sanda discuss this year’s theme “Reclaiming Narratives” with Kelvin J.Akhigbe. “Reclaiming Narratives” marks a significant shift towards recognising and correcting the narratives of Black history and culture. By emphasising “Reclaiming Narratives,” we shine a brighter light on our stories, allegories, and history. Kelvin participated in CM Murray LLP’s recent intern program and is an impressive final year law student at Leeds University. He kindly shared his story about his background, journey to university, his legal experience to date and what has been important to him as a young black man. We are very grateful to Kelvin for sharing his insights. #blackhistorymonth #reclaimingnarratives #blackhistorymonth2024

The SRA’s Draft Guidance on internal investigations is a crucial read for all legal professionals, including inhouse lawyers. My colleagues Gabrielle Lintott and Andrew Pavlovic provide a helpful summary of the Draft Guidance here and outline best practice: #InternalInvestigations #SRA #LawFirmManagement #LegalCompliance
In March 2024 the SRA published draft guidance on internal investigations (“the Draft Guidance”). Whilst published alongside a suite of documents aimed at assisting in house lawyers in complying with their regulatory obligations, the Draft Guidance has a wider reach and is relevant to law firms and any individual appointed to conduct an internal investigation. Since its publication, firms are increasingly referring to the Draft Guidance, both internally when considering whether and how an investigation should be conducted, and in inter partes correspondence when referring to best practice (when acting for either the firm or the individual being investigated). In this news alert, Associate Gabrielle Lintott and Partner Andrew Pavlovic summarise the Draft Guidance and consider the circumstances in which regulatory action could be taken against firms/individuals who fail to investigate matters adequately (or indeed at all): https://lnkd.in/eXBqa4GQ #SRA #Investigations #InternalInvestigations #ProfessionalDiscipline

In the first of this Ten-Minute Talk Employment Rights Bill series, Partner and General Counsel Beth Hale and Trainee Solicitor Mitchell Blythe discuss the key takeaways and practical implications of the new Employment Rights Bill. On 10 October 2024, the Employment Rights Bill was introduced to Parliament. This Bill aims to introduce new workplace rights, end unfair employment practices and help deliver economic growth. In this Ten-Minute Talk, Beth and Mitchell discuss the following: 👉 The introduction of the Employment Rights Bill 👉 The day 1 right to request flexible working 👉 The introduction of a day 1 right not to be unfairly dismissed 👉 Practical considerations for employers and employees in light of the Bill #EmploymentLaw #UKEmpLaw #Employers #Employees #FlexibleWorking #UnfairDismissal
