In this case, the importer failed to realise that the fulfilment house it was using, was not approved by HMRC. HMRC did not accept ignorance of the Fulfilment House Due Diligence Scheme as an excuse and seized, then ultimately destroyed the goods which had been imported into the UK. Although the taxpayer eventually won the appeal and received compensation from HMRC, the goods were lost, and the business endured significant disruption, stress, and costs during the appeal process. This case highlights the critical need for clear communication between overseas customers, UK fulfilment houses, and HMRC. Errors like these can be both damaging and costly. Fulfilment houses that fail to perform required checks and maintain proper records risk significant penalties. However, there is a solution that takes the onus off fulfilment houses, allowing them to focus on fulfilling orders rather than managing paperwork, it can also bring cash flow savings for importers.
