Last evening, members of Essex Court Chambers hosted a panel discussion and drinks reception to mark the publication of the book ''The Principle of Systemic Integration in International Law'' by Campbell McLachlan KC . The panel chaired by Sir Franklin Berman KCMG KC, featured insightful contributions from Campbell McLachlan KC, Alison Macdonald KC, and Professor Martins Paparinskis . Together, they explored the interplay between applicable rules of international law and the impact of Article 31(3)(c) of the Vienna Convention on the Law of Treaties (VCLT) on both international and national case-law. Thank you to everyone who joined us and contributed to making this event truly engaging.

On 20 September 2024, the Court of Appeal of Northern Ireland delivered judgment in the case of Dillon and Ors v Secretary of State for Northern Ireland [2024] NICA 59, concerning the controversial Northern Ireland Troubles (Legacy and Reconciliation) Act 2023 (“the Legacy Act”). The Legacy Act imposed a number of restrictions on legal procedures relating to alleged unlawful acts committed during the period known as the Troubles. Judgment was handed down by the Court of Appeal on 22 October 2024 in two appeals heard jointly over four days this summer: Infrastructure Services Luxembourg S.À.R.L. v. Kingdom of Spain and Border Timbers Limited v. Republic of Zimbabwe [2024] EWCA Civ 1257. The Judgment attempts to reconcile, at Court of Appeal level, a high-profile conflict of authorities at first instance on sovereign immunity and the enforcement of ICSID awards. The central issue before the Court of Appeal was whether the ICSID Convention or its UK implementing legislation deprives foreign states of their general immunity from the adjudicative jurisdiction of the UK courts. In a new approach, the Court of Appeal found that parties to the ICSID Convention have submitted to the enforcement jurisdictions of all ICSID Contracting States. However, it rejected a number of other arguments, including that it was bound by previous Supreme Court authority, and that estoppel precluded States from questioning ICSID arbitral jurisdiction for the purposes of claiming sovereign immunity.
