Is Grey Belt policy ‘largely redundant’?🤔 This is the conclusion reached by the House of Lords Built Environment Committee earlier this month. Grey Belt is defined in the National Planning Policy Framework (2024) as land in the Green Belt comprising previously developed land and/or any other land that, in either case, does not strongly contribute to: • checking the unrestricted sprawl of large built-up areas; • preventing neighbouring towns merging into one another; and • preserving the setting and special character of historic towns. In its consultation response, published alongside the NPPF on 12th December 2024, the Government recognised the “need to provide further guidance to ensure a more consistent approach to assessing Green Belt land” – which the Government said they “will be providing in January 2025.” We are now mid-way through February. At the time of writing, such guidance has not yet been made available. To my knowledge, a date has not been confirmed for when such guidance will be published. While this guidance is awaited, there appear to be a not insubstantial number of appeal decisions being made which tangle with the Grey Belt concept – and offer thoughts on how this policy is to be interpreted by decision makers. An appeal was allowed late last week, which granted planning permission for the construction of a large care home and assisted living units on a site in Buckinghamshire. From the appeal decision, it is clear that the interpretation of Grey Belt policy was material to the granting of the permission. This decision (and others like it) call into question the view that Grey Belt policy is “redundant”. 3 Big mistakes NOT to make on a planning application... and what to do instead! Ethical Planning are seeing a rise in the number of enquiries we receive from those who have encountered problems in submitting a ‘valid’ planning application, or where they have acquired land without doing their homework. If you follow these tips, you will give your planning application (and ultimately your development ambitions) a better chance of success ✅ 👉🏻 Ensure you complete the correct land ownership certificate. It is a legal requirement that owners of land upon which a planning application is being made are notified of that application. If an incorrect ownership certificate is completed as part of a planning application, or the relevant landowners are not notified appropriately, then it can result in your planning permission being made invalid and legally quashed. 👉🏻 Consider the planning status of your land and buildings from the outset. For example, if your land is within Green Belt, a National Park, a World Heritage Site, a Conservation Area, or other sensitive location, then this could influence its development potential. Establishing a baseline understanding of the planning history, site designations and allocations, and associated development opportunities from an early stage can help manage risk and costs in the long run. 👉🏻 Submit a comprehensive planning application that demonstrates your proposals satisfy all the relevant policy tests. Include plans drawn to an appropriate scale, and relevant technical documents that meet the council’s validation requirements. Consider utilising the council’s pre-application advice services, and engage appropriate technical experts to ensure your application is sufficiently robust and 'ticks all the relevant boxes'. Please note that some ecology and other surveys may be seasonally or time constrained. It is therefore important to ‘plan ahead’ to avoid delays to your planning application. Planning officers are under significant strain; contribute where you can to making their job assessing your application as easy as possible! Was this helpful? Upcoming Changes to Planning Fees – Submit Your Application Early to Save The Government has published a Draft Fees Order, introducing significant increases in planning application fees, set to take effect from 1st April 2025. Key changes include: Householder applications: Fees will more than double, rising from £258 to £528. Section 73 applications: A tiered fee structure will replace the current flat fee of £293: - £2,000 for major development variations - £586 for non-major development variations - £86 for householder applications Discharge of conditions: Fees will more than double, increasing from £145 to £298.
