The Chancellor today announced an increase to the additional rate of Stamp Duty Land Tax (SDLT) due when purchasing a second property. From 31 October 2024, the rates of SDLT applicable for the purchase of an additional property will be: Up to £250,000 - 5% The next £675,000 (the portion from £250,001 to £925,000) - 10% The next £575,000 (the portion from £925,001 to £1.5 million - 15% The remaining amount (the portion above £1.5 million) - 17% The immediate implementation of these rate changes and the delay in publishing the supplementary guidance notes caused panic amongst clients who were left in a state of limbo until the budget policy paper was published. Some concerns were eased by the announcement that any clients who are liable for the additional rate, but who have exchanged contracts prior to 31 October 2024, will not have to pay the increased rate, no matter the date of their completion. Property Partner Steven Bannell comments "Whilst it is for the politicians to argue as to the merits of the increase, I must state that the handling of the announcement shows yet again the disdain that successive governments have had for conveyancing solicitors. Not only were clients left in limbo before the policy paper was published and the Gov.uk SDLT guidance updated, but now many will pressure their solicitor to exchange today. Sadly, this is what we have come to expect. I strongly advise all clients who have any concerns or questions regarding SDLT to seek independent tax advice."
