Huge thank you to the Chartered Institute of Arbitrators (CIArb) who yesterday published on their website my keynote speech given at the International Law Summits 7th Annual Conference on Energy Arbitration and Dispute Resolution in the Middle East and Africa, held in London on 30-31 May 2024. It starts like this : " As somebody who practised at the London Bar for 15 years and who has been in the Middle East for the last decade, I can safely state with first-hand knowledge and experience that the Middle East is undergoing significant cultural shifts and reform in various aspects. Disputes worth billions are being heard effectively, executed and enforced with a buy-in of most, bar the odd rogue decision which, let's face it, we have everywhere in the world. I've had the privilege of witnessing the evolution of the legal landscape in the Middle East in various jurisdictions and been a part of that change. I've seen tremendous growth and vision. Over the last ten years, l've worked in various jurisdictions throughout the Middle East. I've witnessed a huge assimilation and coming together between the local and the international, an adoption of best practice with international standards, legislation introduced at a rapid pace, institutions being modernised, and new institutions being introduced." Eltumi Partners’ associate Gofran Abaoub took part in a high-profile conference in London last week focused on energy arbitration and dispute resolution in the Middle East and Africa.   Gofran spoke as part of a panel discussing Energy Arbitration in North African States at the 7th Annual Conference in Energy Arbitration and Dispute Resolution organised by International Law Summits, which took place at the offices of Herbert Smith Freehills.   Her talk encompassed a brief overview of the development of arbitration in the Libyan energy sector, and emphasised the established role it plays as a dispute resolution mechanism.   ICC arbitrations are the preferred forum for energy arbitrations by Libyan energy stakeholders such as the NOC.   Gofran provided a summary of recent developments in Libyan arbitration law, which is based on the UNCITRAL model law, but which remains largely untested in the Libyan courts.   She summarised key developments brought about by the new arbitration law.   Together these lay the groundwork for a more localised arbitration process in Libya; a trend which has already been observed in other North African states such as Egypt. Now that the dust has settled following London International Disputes Week (LIDW), I have had a chance to reflect on this year's International Law Summits Energy Arbitration and Dispute Resolution and the Middle East and Africa Conference. I have to say that I was exceptionally pleased with this edition of the conference (the 7th since 2015). Our keynote speakers, Funke Adekoya and Sarah Malik gave important speeches on the development of arbitration in our focus regions. Our many moderators and panellists provided deep insights and provoked lively discussion with the highly engaged audience. I have to thank our generous hosts, Herbert Smith Freehills, and the team there, our sponsors, International Centre for Dispute Resolution® (ICDR), the international division of American Arbitration Association, and Grant Thornton UK LLP, and our partners, Albertson Solicitors and GCC Commercial Arbitration Centre.
