The OfS define sexual misconduct as “any unwanted or attempted unwanted conduct of a sexual nature. This includes, but is not limited to sexual harassment, sexual assault, and rape”. This presents quite a unique challenge, investigating misconduct that might breach policy and codes to the civil standard, balance of probabilities, that in any other context might be investigated as serious criminal offences to the higher standard, beyond reasonable doubt. This is a proposal for Higher Education to deliver on the requirement to prevent and address harassment and sexual misconduct by outsourcing investigation services to the team at Intersol. Read on to see how Intersol can support and help you address the challenges of investigating serious misconduct that might otherwise amount to criminality: https://lnkd.in/dccpwuQj Ian Hynes Mick Confrey John Crook Philip Adlem Nick Hawkins Independent Higher Education Office of the Independent Adjudicator for Higher Education Conservatoires UK AMOSSHE, The Student Services Organisation Sarah Cavendish #studentdiscipline #studentmisconduct #university #studentexperience #investigation #investigations #workplaceinvestigations #intersolglobal

NEVER has it been more important to outsource specialist workplace investigation to qualified experts who can deliver reliable outcomes. "It's even more important for employers to be proactive and systematic in how they prevent and tackle sexual harassment at work; this is not a 'tick-box' exercise,” Ben Willmott, head of public policy at CIPD, stressed. Employers will now need to demonstrate tangible steps taken to prevent harassment, especially since tribunals now hold the power to increase compensation by up to 25 per cent if they find an employer has breached this duty. Willmott advised businesses to focus on creating a “culture of dignity, respect, and inclusion”, which includes “values-based leadership, effective training for line managers, and robust reporting procedures”. And once reported who is going to investigate? How are they going to investigate? What qualifies them to investigate? Intersol Global can support you to deliver on these legal expectations and fulfil your duty. Rely on your employment lawyer for the legal advice and Intersol Global to provide them with the evidence to inform that advice. Never tire of this lesson for investigators, and never has it been so relevant! Confirmation bias - the investigators nemesis. IF YOU THINK something is true, work as hard as you can to prove that it isn't! The science of investigation.

Do phrases such as "accused", "complainant" have a place in a civil workplace investigation? How important is balancing organisational and individual reputation with a non-judgemental and open-minded investigation? Is an "experienced HR professional" the same as an "external investigator"? Can you guarantee anonymity of the complainant (reporting party)? How (and where) will you document decisions and the rationale behind them so that you can explain to the tribunal in 3 years time? Should "complainants" be automatically believed? Is a false complaint the same as vexatious? Why aren't investigators qualified to (at least) OFQUAL Level 3 investigation AND investigative interviewing (meetings)? "Investigation of such delicate issues is no place for the enthusiastic amateur" (UK KC). At Intersol Global we help and support with ALL stages of the process, from policy to outcome. We can QUALIFY your staff to investigate better or do it with/for you. Whichever, investigation advice is FREE so let us help you prepare the ground for compliance. Food for thought? There is a solution out there -the OFQUAL level 3 certificate in investigative interviewing. See: https://lnkd.in/gk7-4avJ Developed in partnership with Skillsfirst, this should be the minimum start-point for anyone entrusted with conducting workplace investigation meetings. Only half? Anecdotally surprised it's not much more. At a recent HR workshop whistleblowers were repeatedly referred to as "disgruntled employees" that presented a threat to company reputation. Until there is a paradigm change in how whistleblowers are perceived and managed this, legitimate it would seem, fear will persist. This is a compelling reason why only the most skilled workplace investigative interviewers should 'interview' a whistleblower. IF their motive is vexatious or mischievous, even a falsehood, a skilled interviewer will expose them. If not they will become a most compelling key workplace witness. The dilemma for companies or institutions? There's none so blind as those that don't want to see maybe? WhistleblowersUK Whistleblower Partners LLP Intersol Global #whistleblower #whistleblowing
