ESG is a topic which affects all businesses. It is central to the strategic management of a company, yet integrating ESG into business strategy remains a principal challenge for the C-suite. While more and more companies are appointing Chief Sustainability Officers, it is often the General Counsel/Chief Legal Officer that is tasked with sitting on internal committees to ensure that the business is complying with all relevant legal frameworks, particularly in FMCG companies. When a candidate has two equally appealing offers, it’s a nice position to be in - but can also be a stressful one. Transitioning to a Non-Executive Director role can be a powerful career move for General Counsel. Effective GCs are inherently strategic thinkers, which makes stepping into a governance-focused role a natural evolution. The out of cycle bonuses we have seen this year from firms to this point have been from litigation boutiques. These bonuses are normally paid when these firms have won significant contingent fees. This is the first move from a biglaw firm. I am really interested to see if the rest of the market will be able to match this. Milbank has an incredibly strong Energy & Infra practice which drives profitability. For many firms driven by PE and M&A practices, I think they will struggle to justify additional bonuses, given deal activity is still somewhat subdued.
