Taking a quick break from games and tech law today to talk about... #antitrust. And #luxury accessories. No, I don't have a fever (thanks, your concerns are appreciated!), but I wanted to flag the recent court decision wherein an antitrust judge sided with the US FTC's analysis that there are three tiers of handbags: 🛍️ Mass Market, also referred to as Fast Fashion (ouch, that 🔥 must hurt...) 💼 Accessible Luxury, also referred to as Affordable Luxury (kind of like a "Salary Partner" in a law firm?) 👜 Luxury, also referred to, among other things, as True Luxury or 🇪🇺 European Luxury (yeah, I'll let that last one sink in). (see pp. 20/21 of the decision, available here: https://lnkd.in/gjMy39gZ) The court then proceeded to block a merger in the Accessible Luxury category, following the #FTC's argument that the companies in that space do not really compete with the actual Luxury brands. Full disclosure: The decision is already under appeal. Today marks the final day of COP16 in Cali, Colombia. The two-week conference has been filled with calls for global leaders to make serious financial commitments to halt nature's decline. 🌎 Yesterday, the EU reaffirmed its commitment to restoring biodiversity through a financial package of almost €160 million. This package aims to assist Africa, Asia, Latin America, and the Caribbean in nature restoration, combat illegal wildlife trafficking, conserve our oceans, leverage private capital to fund the effort, and increase biodiversity certification and nature credits. 🌿 As the penultimate day of COP16 commences, there is an optimism that a consensus will be reached on implementing the Kuming-Montreal Global Biodiversity Framework. This framework, adopted at COP15 in 2022, sets out a pathway to reverse biodiversity loss by 2030. UN Secretary General António Guterres has expressed confidence that an agreement will be reached, pointing to significant compromises and collaboration between the delegates so far. This collaborative sprit could be seen in action yesterday with the signing of a resolution on the Public Policy of Agroecology in Colombia. This is intended to mark a move towards sustainable agri-food practices that protect biodiversity and away from more traditional agriculture models. 🌿 🌍 We joined with Loan Market Association (LMA) to co-host a roundtable event with investors and lenders to explore the challenges and opportunities relating to natural capital. The topic prompted an interesting and wide-ranging discussion – here are some of the key takeaways: • Beyond Biodiversity Net Gain in England, much of the natural capital market is driven by voluntary disclosure requirements. • While this creates opportunity for early adopters, there is a lack of standardisation of terminology which can act as a barrier to entry. • As a result, there is currently a gap between the number of projects seeking investment and the availability of willing investors. • Things are moving quickly, with some exciting developments linked to natural capital projects in emerging markets which may offer interesting opportunities for investors keen to get involved. • However, there is still a need for supportive regulatory initiatives to boost trust and alleviate investor concerns in the natural capital market. • Given the market is in its infancy, there is a prime opportunity now for businesses, investors, and lenders to get ahead of the curve on natural capital 🌱 With the Convention on Biological Diversity (COP16) underway (21 October-1 November 2024), it is a very interesting time for natural capital, given the spotlight the Convention will turn on current uncertainties, as well as the market's potential. 🌱 If you want to discuss natural capital further, please contact one of our experts: Matthew Germain, Caroline Bush, Julian Wolfgramm-King, Arthur Hopkinson and Lauren Gardner. #NaturalCapital #Investment #BiodiversityNetGain #NaturalCapitalMarkets
