Failed Insulation Scandal a "Ticking Time Bomb," Warns SSB Law Victims Support Group The failed insulation scandal has been described as a "ticking time bomb" that could impact thousands of homes unless urgent action is taken by the Government. This warning was delivered by the SSB Law Victims Support Group during a meeting with MPs in Parliament. The group, which represents homeowners affected by faulty insulation installations, emphasised the need for immediate intervention to prevent further damage and financial strain on victims. The lobby was the result of a joint campaign spearheaded by the support group that is supporting many victims.  Several prominent MPs, including Burnley, Padiham, and Brierfield MP Oliver Ryan and Bradford East MP Imran Hussain were in attendance. Both MPs have been vocal advocates for the affected residents. This week, Mr Hussain also put down an early day motion which highlights the importance of home insulation measures but making mention of the “devastating consequences” for people where cavity wall insultation was not properly installed. At the meeting, Debra Sofia Magdalene who is leading the SSB Victims Support Group,  shared stories of how the substandard insulation had caused extensive damage to homes, leading to structural issues, dampness, and health concerns. Despite raising these issues for years, many have received little or no support, with some facing legal battles due to the collapse of SSB Law, the firm originally handling their cases. Debra said. : “We’ve got legal firms like SSB Law that exacerbate the problems through negligence, leaving victims in legal limbo. The government’s failed to support these victims in holding responsible parties accountable.” The MPs echoed the group's concerns, urging the Government to act swiftly before the crisis worsens. “This is a growing problem that cannot be ignored any longer,” said MP Oliver Ryan. Imran Hussain added, "Without immediate action, thousands more homes could face serious issues, and families will be left to bear the costs." The SSB Law Victims Support Group remains committed to ensuring that justice is served, and today's meeting in Parliament marks a critical step in pushing for long-overdue government intervention. David Wingate is acting for a number of clients who have been affected by the collapse of SSB. David has also met with several MPs and attended meetings with affected home owners. #SSBLaw #SSBCollapse #WEsolicitors

What to Do If You Think Your Barrister Has Been Negligent Engaging a barrister is often a crucial step during legal proceedings. However, there are times when you might feel that your barrister has not provided the service you expected. Negligence in legal representation can have serious consequences, but it's important to know how to address this issue. Here’s a guide on what to do if you believe a barrister has been negligent. Understand What Constitutes Negligence Legal negligence occurs when a barrister fails to provide the standard of care that a reasonably competent barrister would provide under similar circumstances, resulting in harm or loss to the client. This could include: Providing incorrect legal advice. Missing important deadlines. Failing to properly prepare for court. Not following your instructions. Gathering Evidence Document everything related to your case: Communications: Emails, letters, and notes from telephone calls and any conferences. Documents: Copies of all legal documents and correspondence. Timelines: Detailed timelines of events and actions taken by your barrister. Obtain a Second Opinion Before taking further steps, it’s a good idea to consult another barrister or solicitor. Another pair of eyes is often helpful. Asking another professional to take a look can provide perspective on whether negligence occurred and the potential impact on your case. Communicate Your Concerns Raise your concerns directly with your barrister or their chambers. They may be able to explain their actions or rectify the situation. A formal letter outlining your grievances and requesting a response can often be a good approach. File a Complaint If direct communication does not resolve the issue, you can file a formal complaint: You can report professional misconduct to the BSB, which regulates barristers. Legal Ombudsman:** You can also approach the Legal Ombudsman, who deals with complaints about legal service providers. Consider Legal Action If you have suffered significant financial loss due to negligence, you may wish to consider legal action: Professional Negligence Claim: This involves proving that the barrister owed you a duty of care, breached that duty, and caused you a loss as a result. Seek Alternative Dispute Resolution (ADR) Mediation or arbitration can be a quicker and less costly way to resolve disputes compared to litigation. ADR can often result in a satisfactory outcome without the need for court intervention. While the hope is always that your barrister will provide exemplary service, understanding your rights and options if things go wrong is crucial. By taking the appropriate steps, you can address potential negligence effectively. Feel free to share your thoughts or experiences on this topic in the comments below. Your insights could be invaluable to others facing similar situations. #LegalAdvice #BarristerNegligence #ProfessionalNegligence #LegalSupport

This week, David Wingate attended a meeting in Westminster concerning the collapse of law firm SSB. The meeting had cross-party support with a number of MPs attending the meeting and the representatives of other MPs who were unable to be there.    Some extremely powerful stories were shared, detailing the misery caused by the adverse costs orders, which included the tragic death of Ian Lofthouse. There were also equally powerful stories of the misery caused by damage to homes and the stress and health conditions of living in mouldy properties   MPs are not only concerned by what has happened, given that public money was used for cavity wall insulation, but also the lack of consumer protection arising from the failed litigation and whether or not ‘No Win, No Fee’ is misleading.   They are very concerned that the SSB victims are the tip of the iceberg in terms of damage to homes arising from the CWI scheme. There are plans to push the matter with the relevant government departments and the secretaries of state   After the meeting, David spoke with several of the MPs in attendance together with Debra Magdalene, a lady who has helped to set up a support network for the people who have been affected by the collapse of SSB.    David Wingate: “It was very clear that MPs are extremely concerned by what they have heard from the SSB Victim Support Group. They are keen to help in pushing for a resolution to the adverse costs claims and as to what can be done to repair homes that have been damaged by cavity wall insultation. On a wider note, they also want to ensure that any future green homes initiatives are administered properly and better protection for consumers entering into conditional fee agreements are put in place.”   #ssbcollapse #ssblaw #cavitywall #wesolicitors

Last week, Rishi Sunak was asked by Naz Shah MP if he would investigate the collapse of SSB law. Naz has a number of constituents who have been impacted by the closure of this firm, leaving many of them living in fear of bailiffs appearing at their doors. The Prime Minister said he would examine the situation and get back to her as quickly as possible. This intervention has been met with renewed hope for large numbers of people who are desperately worried. Sunak said he would ensure that the right minister will look into the matter.
