What to Do If You Think Your Barrister Has Been Negligent Engaging a barrister is often a crucial step during legal proceedings. However, there are times when you might feel that your barrister has not provided the service you expected. Negligence in legal representation can have serious consequences, but it's important to know how to address this issue. Here’s a guide on what to do if you believe a barrister has been negligent. Understand What Constitutes Negligence Legal negligence occurs when a barrister fails to provide the standard of care that a reasonably competent barrister would provide under similar circumstances, resulting in harm or loss to the client. This could include: Providing incorrect legal advice. Missing important deadlines. Failing to properly prepare for court. Not following your instructions. Gathering Evidence Document everything related to your case: Communications: Emails, letters, and notes from telephone calls and any conferences. Documents: Copies of all legal documents and correspondence. Timelines: Detailed timelines of events and actions taken by your barrister. Obtain a Second Opinion Before taking further steps, it’s a good idea to consult another barrister or solicitor. Another pair of eyes is often helpful. Asking another professional to take a look can provide perspective on whether negligence occurred and the potential impact on your case. Communicate Your Concerns Raise your concerns directly with your barrister or their chambers. They may be able to explain their actions or rectify the situation. A formal letter outlining your grievances and requesting a response can often be a good approach. File a Complaint If direct communication does not resolve the issue, you can file a formal complaint: You can report professional misconduct to the BSB, which regulates barristers. Legal Ombudsman:** You can also approach the Legal Ombudsman, who deals with complaints about legal service providers. Consider Legal Action If you have suffered significant financial loss due to negligence, you may wish to consider legal action: Professional Negligence Claim: This involves proving that the barrister owed you a duty of care, breached that duty, and caused you a loss as a result. Seek Alternative Dispute Resolution (ADR) Mediation or arbitration can be a quicker and less costly way to resolve disputes compared to litigation. ADR can often result in a satisfactory outcome without the need for court intervention. While the hope is always that your barrister will provide exemplary service, understanding your rights and options if things go wrong is crucial. By taking the appropriate steps, you can address potential negligence effectively. Feel free to share your thoughts or experiences on this topic in the comments below. Your insights could be invaluable to others facing similar situations. #LegalAdvice #BarristerNegligence #ProfessionalNegligence #LegalSupport

The collapse of SSB Law continues to make headlines. Last week the BBC featured several clients who have been left with legal bills that they simply cannot afford to pay. David Wingate who is acting for a number of the clients appeared on Morning Live to explain more. https://lnkd.in/egE7gXi4

This week, David Wingate attended a meeting in Westminster concerning the collapse of law firm SSB. The meeting had cross-party support with a number of MPs attending the meeting and the representatives of other MPs who were unable to be there. Some extremely powerful stories were shared, detailing the misery caused by the adverse costs orders, which included the tragic death of Ian Lofthouse. There were also equally powerful stories of the misery caused by damage to homes and the stress and health conditions of living in mouldy properties MPs are not only concerned by what has happened, given that public money was used for cavity wall insulation, but also the lack of consumer protection arising from the failed litigation and whether or not ‘No Win, No Fee’ is misleading. They are very concerned that the SSB victims are the tip of the iceberg in terms of damage to homes arising from the CWI scheme. There are plans to push the matter with the relevant government departments and the secretaries of state After the meeting, David spoke with several of the MPs in attendance together with Debra Magdalene, a lady who has helped to set up a support network for the people who have been affected by the collapse of SSB. David Wingate: “It was very clear that MPs are extremely concerned by what they have heard from the SSB Victim Support Group. They are keen to help in pushing for a resolution to the adverse costs claims and as to what can be done to repair homes that have been damaged by cavity wall insultation. On a wider note, they also want to ensure that any future green homes initiatives are administered properly and better protection for consumers entering into conditional fee agreements are put in place.” #ssbcollapse #ssblaw #cavitywall #wesolicitors

Last week, Rishi Sunak was asked by Naz Shah MP if he would investigate the collapse of SSB law. Naz has a number of constituents who have been impacted by the closure of this firm, leaving many of them living in fear of bailiffs appearing at their doors. The Prime Minister said he would examine the situation and get back to her as quickly as possible. This intervention has been met with renewed hope for large numbers of people who are desperately worried. Sunak said he would ensure that the right minister will look into the matter.

It is always worrying to hear of law firms that have had to close or have been closed by the Solicitors Regulation Authority. We have been working very closely with a number of clients who were affected by the closure of SSB Law, and yesterday we learned of the closure of Jarmans. https://rb.gy/kgyywz

It has been a very stressful time for a number of clients who have been affected by the closure of SSB. We are still taking calls from people who have been left extremely upset and confused. David Wingate was interviewed by Yorkshire Legal and provides a valuable insight into issues surrounding the closure of this law firm. “I think SSB has done a lot to undermine the trust that people have in solicitors. People should be able to trust solicitors, and something has gone gravely wrong in this instance.” #ssblaw #lawfirmclosure #ssb #wesolicitors
Following the shocking collapse of SSB Law in Sheffield, hundreds of innocent former clients have been lumbered with cost orders. Many of these victims have now been left with nowhere to turn. David Wingate is a professional negligence solicitor looking to obtain justice for those affected. He sat down with Yorkshire Legal News to discuss the fallout and the best next steps forward for those who don’t know where to go for help in the wake of the collapse. https://lnkd.in/eUY43ThA

This week, David has had a constructive meeting at the offices of Judith Cummins, Member of Parliament for Bradford South, to address the fallout from the collapse of SSB Law Firm. The discussion focused on why constituents have been left with bills to pay and how David can support those affected. SSB Law, unexpectedly closed its doors leaving numerous clients being chased for legal costs and unsure about the fate of their ongoing cases. The closure of SSB has left many individuals and businesses in a vulnerable position and financial losses. David is a highly experienced solicitor specialising in professional negligence cases, has been closely following the situation at SSB Law Firm. Recognising the need for immediate action, David has sought to establish partnerships with Members of Parliament, and other stakeholders, to find a way forward for those affected. During the face-to-face meeting, David discussed the full scale of the problem and the pressing issues being faced by SSB's former clients. He highlighted the importance of engaging early with solicitors to minimise the losses accruing. David’s primary goal is to put the affected clients' needs first, providing them with personalised support and reassurance during this difficult period. He pledged to investigate any potential malpractice or negligence that may have contributed to the law firm's collapse, thereby seeking to hold accountable those responsible for causing harm to innocent victims. We are very grateful to Judith and her team for making sure that her constituents obtain some solid legal advice. David’s next meeting is with Antony Higginbotham, MP for Burnley and Padiham. This follows the question he raised in Parliament regarding the issues faced by his own constituents. #ssblaw #ssb #cavitywallclaims #solicitor
