    Yesterday I attended the ICC United Kingdom Annual Arbitration and ADR Conference 2024, kindly hosted by Simmons & Simmons A wide variety of topics were discussed, with each talk offering its own valuable and insightful perspectives. A few of my key takeaways include: • 𝗧𝗵𝗲 𝗱𝗶𝘀𝗰𝘂𝘀𝘀𝗶𝗼𝗻 𝘀𝘂𝗿𝗿𝗼𝘂𝗻𝗱𝗶𝗻𝗴 𝘁𝗵𝗲 𝗿𝗼𝗹𝗲 𝗼𝗳 𝘁𝗵𝗲 𝘁𝗿𝗶𝗯𝘂𝗻𝗮𝗹 𝗮𝗻𝗱, 𝗶𝗻 𝗽𝗮𝗿𝘁𝗶𝗰𝘂𝗹𝗮𝗿, 𝘁𝗵𝗲 “𝗶𝗻𝗾𝘂𝗶𝘀𝗶𝘁𝗶𝘃𝗲 𝗮𝗿𝗯𝗶𝘁𝗿𝗮𝗹 𝘁𝗿𝗶𝗯𝘂𝗻𝗮𝗹”: as addressed by the Hon Mr Justice Robin Knowles CBE and the panel that followed him, in certain circumstances it may be necessary for arbitrators to play a more inquisitory role, going beyond the parties' submissions and asking “original questions” in its quest to deliver a truly fair and just outcome. This inquisitory role may be, in particular, engaged during document production but also in defining the list of issues to be addressed by the Tribunal. • 𝗧𝗵𝗲 "𝘂𝗻𝘄𝗿𝗶𝘁𝘁𝗲𝗻 𝗿𝘂𝗹𝗲𝘀" 𝗼𝗻 𝘁𝗵𝗲 𝘁𝗮𝗸𝗶𝗻𝗴 𝗼𝗳 𝗲𝘃𝗶𝗱𝗲𝗻𝗰𝗲 𝗶𝗻 𝗶𝗻𝘁𝗲𝗿𝗻𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗮𝗿𝗯𝗶𝘁𝗿𝗮𝘁𝗶𝗼𝗻, 𝗮𝗻𝗱 𝘁𝗵𝗲 𝗱𝗶𝘃𝗲𝗿𝗴𝗲𝗻𝗰𝗲 𝗯𝗲𝘁𝘄𝗲𝗲𝗻 𝗰𝗼𝗺𝗺𝗼𝗻 𝗹𝗮𝘄 𝘃 𝗰𝗶𝘃𝗶𝗹 𝗹𝗮𝘄 𝗷𝘂𝗿𝗶𝘀𝗱𝗶𝗰𝘁𝗶𝗼𝗻𝘀: counsel from different jurisdictions, as James Shaerf put it, carry on their back their own distinct professional obligations, irrespective of the arbitration seat. This can lead to an inequality of arms between opposing counsel, notably when it comes to the ability to "prepare" a witness. •𝗧𝗵𝗲 𝘂𝘀𝗲 𝗼𝗳 𝗔𝗜 𝗶𝗻 𝗹𝗲𝗴𝗮𝗹 𝘀𝗲𝗿𝘃𝗶𝗰𝗲𝘀, 𝗽𝗮𝗿𝘁𝗶𝗰𝘂𝗹𝗮𝗿𝗹𝘆 𝗶𝗻 𝗮𝗿𝗯𝗶𝘁𝗿𝗮𝘁𝗶𝗼𝗻𝘀: the incredibly qualified panel conducted a SWOT analysis of AI, sparking some interesting debates, especially on weaknesses. One of the greatest issues AI currently faces in the legal context is 𝘵𝘳𝘢𝘯𝘴𝘱𝘢𝘳𝘦𝘯𝘤𝘺. In AI's current iteration, it is often difficult to explain a particular output, how it arrived at this output and what data it used. Against this background, should AI be used in arbitrations? After all, arbitration is hallmarked as the quicker, cost-effective alternative to litigation. To this end, should parties or even the arbitral tribunal have a duty to disclose their use of AI?     Expedited procedures in international arbitration. I look forward to taking part in the final webinar on Day 1 of the ICC United Kingdom Annual Arbitration & ADR Conference on Wednesday 23rd October at 13.30. The Expedited Procedure Provisions were among the major reforms introduced by the ICC International Court of Arbitration during Alexis Mourre's presidency. They offer a quicker and more cost-effective process involving a sole arbitrator, a deadline for an award 6 months from the CMC, and reduced fees. A record 189 new cases were filed under the ICC's EPP in 2023. 39.5% of new cases filed with the ICC in 2023 involved an amount in dispute not exceeding US$3m, the threshold for the automatic application of the EPP for disputes arising out of arbitration agreements concluded after 1 January 2021. As far as London-seated arbitrations are concerned, the challenge for the ICC and other institutions is that ordinary procedures for ad hoc arbitrations under the Arbitration Act 1996 can be faster. For example, under section 16(5), the time required for the formation of a 3-member tribunal should not be longer than two and a half weeks from the notice commencing arbitration. My contribution will put the EPP and other expedited rules in context, including competition from disintermediated arbitration and traditional documents only procedures which remain dominant in London. My co-panellists Kim Franklin KC and Rana Obeid will look at expedited procedures in construction disputes, including the EPP, and dispute resolution clauses to deal with claims of different sizes.     Costas Frangeskides and Peter Deegan are pleased to be attending the EFNI Sopot Conference 2024.   The European Forum for New Ideas is one of the largest conferences in this part of Europe, dedicated to global trends, new ideas and the future of Europe.   Costas Frangeskides will be participating on the panel "Business goes to court: needs, alternatives, opportunities" October 18th, 2024, 2:00 p.m. - 3:00 p.m. Alongside participants: Mariusz Haładyj, President of the General Prosecutor’s Office of the Republic of Poland, Agnieszka Siedlecka-Andrychowicz, Polish Confederation Lewiatan, Paweł Dziekoński, Vice-President, Fakro Group, Moderation: Katarzyna Bilewska, professor, Partner at BLSK Law Firm Dispute resolution instruments and the needs of business. This is an extremely important topic from the perspective of companies, although it rarely appears in the mainstream public debate. Meanwhile, it is worth considering where the sources of business risk in relation to litigation lie, both in Poland and abroad? Recent judgments reveal that these approaches threaten the Civil Procedure Rules’ goal of ensuring justice and efficiency. As clients adopt more aggressive US-style strategies, judicial frustration is rising. The article emphasises the need to balance strong representation with adherence to CPR principles.
