The Department of Justice (DOJ) has warned that a lawsuit challenging federal cannabis prohibition could disrupt ongoing efforts to reschedule marijuana from Schedule I to Schedule III under the Controlled Substances Act. Filed by cannabis companies, the lawsuit argues that federal marijuana laws conflict with state-legal cannabis programs. The DOJ contends that a victory for the plaintiffs would undermine Congress's ability to regulate marijuana even if it is rescheduled. The case is currently under review by the First Circuit Court of Appeals. Republican Senator Rand Paul has introduced the HEMP Act, proposing to raise the THC limit for federally legal hemp from 0.3% to 1% on a dry-weight basis. Vice President and Democratic presidential nominee Kamala Harris voices her support for cannabis legalization.

Kentucky has approved its first-ever medical marijuana business license for a testing lab, marking a major milestone in the state's cannabis regulation efforts. A licensing lottery for cultivators and processors is scheduled for October 28, 2024, allowing the state's medical cannabis market to move forward. The lottery will be run by the Kentucky Lottery Corporation and is expected to streamline the selection process. A separate licensing lottery for dispensaries is expected in November, as the state continues to build its medical cannabis infrastructure.
