"Preponderance of the Evidence" is the prevailing phrase in a South Carolina tidelands tracts dispute involving King's grants issued 300 years ago. A challenger to the State of South Carolina’s presumption of title to tidelands need only rebut that presumption by the preponderance of the evidence (50% plus 1). Clear and convincing evidence, a higher standard between the traditional civil preponderance of the evidence standard and the criminal beyond a reasonable doubt standard, is not necessary. The Federal Trade Commission’s rule banning most non-compete agreements has hit its first major legal obstacle. A Texas federal court issued a preliminary injunction, partially blocking the federal ban scheduled to take effect in September. While the injunction only applies to the litigation parties, the judge's strongly-worded 33-page opinion is a first major signal that the FTC rule may not pass judicial review. "Are College Athletes Considered Employees?" - A U.S. appeals court left open that possibility on Thursday in a major victory for student athletes. The #NCAA had sought a definitive ruling to prevent athletes from claiming #employee status. However, the 3rd U.S. Circuit Court of Appeals declined to make such a determination in Johnson v. NCAA. The case was sent back to a lower court for further examination.
