Since the enactment of Medicare Part D in 2006, drug manufacturers around the world have exploited the Medicare Trust Fund by circumventing congressional rules designed to place a ceiling on drug prices. By discretely using alleged 501(c)(3) charities to funnel subsidies and waive copayment requirements for Medicare beneficiaries, drug manufacturers have been able to increase the prices of their drugs to exorbitant levels, leaving tax payors to foot the bill. The Department of Justice, along with various Congressional committees, have exerted tremendous efforts and resources to expose such practices and bring drug prices down. The class actions filed by our team against Teva and other drug manufacturers, alleged charities, and certain pharmacies, compliment these efforts and seek reimbursement (on a class-wide basis) of taxpayor dollars wrongfully depleted from the Medicare Trust Fund since 2006. Win or lose, it is important to us that we do our part in keeping the conversation around exorbitant drug pricing and healthcare costs alive. The US healthcare system can be improved and taxpayers should know that those that wrongfully obtain their hard-earned dollars will be held accountable. This lawsuit alleges that Teva engaged in racketeering activity in violation of the mail and wire fraud statutes, state and federal bribery laws, state consumer protection laws, among others. Firm Update: On April 25, 2023, @akeelvalentine and our co-counsel (MSP Recovery Law Firm) filed a Class Action Complaint on behalf of LifeWallet and all third party payors who were deceived into using taxpayer dollars to pay for overpriced drugs. After the Department of Justice announced a settlement of $23.85 million and informed the public of a years long scheme to defraud Medicare, we initiated this lawsuit against Amgen and Onyx Pharmaceuticals, asserting RICO and Consumer Protection Claims. On July 16, 2024, Hon. Judge Maame Ewusi-Mensah Frimpong rejected Defendants’ attempts to dismiss the case. Discovery will now proceed.
