In a groundbreaking decision, U.S. District Judge Kathyrn Kimball Mizelle of the Middle District of Florida has ruled that the False Claims Act’s (FCA) qui tam device is unconstitutional. The case, Zafirov v. Florida Medical Associates LLC, involved a challenge to the FCA’s qui tam provisions, which allow private individuals (relators) to bring lawsuits on behalf of the government. Defendants argued that this mechanism violates Article II’s Appointments Clause, Vesting Clause, and Take Care Clause. The Eleventh Circuit recently held that graduates of the Minority Small Business and Capital Ownership Development Program (commonly known as the 8(a) program) are nonetheless subject to certain program requirements as long as they continue to perform under existing contracts, and that violation of those requirements can lead to False Claims Act liability under a fraudulent inducement theory. In Gose v. Native Am. Servs. Corp., the court reversed the district court’s grant of defendants’ motion to dismiss, holding that the relators sufficiently alleged defendants were “participants” in the program and their failure to report a change in ownership/control rendered bids for new work under existing contracts fraudulent.
