Beverlin and Kerri Sakaue recently obtained a ruling granting summary judgment in favor of their client McLane Foodservice, Inc. that two truck drivers who filed a nationwide putative collective claiming they were not paid overtime while working more than 40 hours per week, as allegedly required under the Fair Labor Standards Act, were in fact exempt from overtime under the Motor Carrier Act.
