In the first known case to challenge California's legislative attempt to void noncompete agreements even for employees who do not live or work in California, the First Circuit Court of Appeals upheld the application of Massachusetts law, ignoring the California law's mandate. This is just the first test of California's new law. It remains to be seen whether in other cases, each with their own unique facts, the potentially nationwide impact that California's law has on noncompete provisions will withstand scrutiny by courts in other states. As the U.S. presidential election approaches, its potential outcomes could significantly impact regional and global energy markets and commodity trade flows. Our Singapore Office recently hosted a seminar titled “The U.S. Presidential Election: Implications for Global Energy Markets and Relevance to APAC.” Our speakers, Jeff Schlegel, Paul Greening, and Darren Murphy, delivered an in-depth analysis of the election's possible impacts on energy markets generally and more particularly in Asia and Australia, exploring various scenarios and offering valuable insights for regional and international companies active in, or potentially affected by, changes in energy markets. We thank our speakers and all the guests who participated. #energy #energymarkets

In a potentially seismic development, a federal district court in Florida held that the False Claims Act's qui tam provisions violate the Constitution's Appointments Clause—a ruling that, if upheld, would upend the landscape of FCA litigation. It appears inevitable that this decision will be appealed to the Eleventh Circuit and, potentially, to the Supreme Court. To learn more about this major ruling, click below to download our Alert. The Mexican Senate recently approved a bill that would amend the constitution to provide for the democratic election of judges. The reforms and other incoming bills create a high degree of uncertainty surrounding Mexico's future investments. We would expect any risks to emerge first in the energy, oil and gas, and telecom sectors, where foreign investments may compete with Mexican monopolies. To learn more about the impact of these significant reforms on the risk landscape for foreign investment in Mexico, click below to download our Commentary.
