It now appears likely that at least some temporary disruption from a dockworker strike on the U.S. East and Gulf Coast ports will begin on Tuesday (October 1). Despite hopes that the two sides would meet to resolve their differences, the ILA has not returned to the negotiating table. The USMX has tried to force the union back to contract talks by filing a complaint with the National Labor Relations Board, but industry experts believe it’s now too late to prevent a strike. It’s important to note that while a strike would most directly impact the 36 East and Gulf Coast ports, all modes and ports will feel the impact as cargo owners work to reroute cargo to air, truck, rail, and alternate U.S. and Canadian ports. Below is a brief overview of key points related to a potential strike that we hope will help you prepare your business for this disruption. Potential East and Gulf Coast Strike – Overview - Ocean exports from East and Gulf Coast ports and inland rail moves to those ports are mostly embargoed. -Drayage and trucking firms are “pre-pulling” cargo from East and Gulf Coast ports, moving containers east-to-west on the rail, and engaging space to transload and store goods and containers. -Trucker’s yards are filling, capacity is growing scarce, and rates are rising. -The carriers have implemented port congestion/disruption fees - surcharges between $1,000 - $3,000 per FEU - Reefer containers will not be maintained during a strike, but charges for power may still accumulate - Any unreturned empties may still accrue detention charges, especially on any chassis, depending on the chassis owner’s policies. - The FMC has indicated it will not support the billing of demurrage and detention charges on containers that cannot be accessed due to a strike. However, some terminals still indicate that containers already in demurrage at the start of a strike will continue to accrue charges. - Expect backlogs when ports reopen along with potential demurrage and detention charges; experts estimate one week of delay for every day the terminals are closed. - Ships enroute to impacted ports that are not unladen before a strike will likely slow steam and then drop anchor near the port in the near term Capacity into West Coast ports, Canada, and Mexico via truck and rail will be at a premium, capacity will be limited, and delays may occur.
