DEFENSE VERDICT ALERT! - Amy Adamo v. Jessica Parr Orange County Superior Court Case No. 30:2020-01154453-CU-PO-CJC We are proud to announce that Arthur J. Chapman and Chelsea L. Zwart have recently obtained a defense verdict in a personal injury matter litigated by Mr. Chapman for over four years. The action arose out of an incident that occurred between Plaintiff Amy Adamo and Defendant Jessica Parr on June 2, 2018, at the Monarch Beach Club in Laguna Beach. The parties, who were close friends at the time, were attending a school event for their children at the Club. The parties agreed that while at the event, Defendant observed Plaintiff from a distance and approached Plaintiff from behind to greet her. The parties disagreed on what happened next. Plaintiff claimed that Defendant acted negligently in coming up from behind her quietly and jumping on her back "piggy-back" style, causing her to fall and sustain injuries to her back, neck, and left hip, resulting in prolonged pain and medical treatment. Defendant denied the allegations and claimed that she greeted Plaintiff with a friendly hug from behind. Defendant denied causing any harm to Plaintiff, and at trial disputed both the nature and extent of Plaintiff's claimed injuries. At trial, Plaintiff's own witness (an attorney) testified that Plaintiff had not fallen as a result of the incident, as Plaintiff herself claimed, but stated that Plaintiff had clearly sustained injuries as a result of Defendant jumping on her back and was in pain immediately thereafter. In addition to presenting her own testimony, Plaintiff also called her treating physician, Dr. Michael Gordon, to provide testimony that Plaintiff had sustained significant injuries to her back, neck, and left hip and that the same were a result of the incident. On Defendant's side, Defendant and one defense witness testified that Defendant had only hugged Plaintiff from behind in a friendly manner and that Plaintiff had not fallen. During closing argument, Plaintiff's counsel requested an award of at least $180,000 to Plaintiff, heavily relying on argument regarding the purported credibility of Plaintiff's treating physician and attorney-eyewitness. Defense counsel pointed out the inconsistencies in Plaintiff's testimony (including that her own witness contradicted her testimony that she fell) and in her medical records. Ultimately, after deliberating for 2 days, twice as long as it had taken for all the evidence to be presented, the jury rendered a 10-2 defense verdict. Notably, Plaintiff’s medical specials were stipulated to be $17,200 and the parties stipulated that Plaintiff's claimed future pain and suffering were cut off as of January 2022, due to a subsequent, unrelated accident. Prior to trial, Plaintiff issued a 998 Offer to Compromise for $250,000 and Defendant's highest offer was $10,000.
