Dahlia (Aronson) Ehrenfried – Co-Chair (U.S.) Senior Director, Marketing, Business Development, and Coaching (MBDC) Dahlia is a marketing strategist with nearly 30 years of experience and an MBA from Boston University. She is known for her expertise in developing client-focused marketing strategies and driving business growth in professional services. As Co-Chair, Dahlia is committed to helping CRA colleagues harness their skills and achieve their professional goals. On October 31, 2024, the European Commission imposed a €462.6 million fine on Teva for delaying competition for its multiple sclerosis treatment, Copaxone, across seven EU Member States. #CRACompetition’s Raphaël De Coninck and Elina Koustoumpardi advised third parties in this pivotal case, in which the Commission found that Teva misused the patent system by creating a “web of secondary patents” to obstruct rivals and prevent market entry. Additionally, the Commission found that Teva disseminated misleading information about the safety and efficacy of a competitor’s product, despite that product having received regulatory approval as a safe and bioequivalent product to Teva’s Copaxone. In a recent article titled, “Smallest saleable patent-practicing unit in life sciences disputes,” #CRALifeSciences Erin McDermott explores calculating damages in IP disputes by focusing on “reasonable royalties” for patent infringement. McDermott highlights the challenge of determining an appropriate “royalty base” for multicomponent products, often limited to the smallest saleable patent-practicing unit (SSPPU). While traditionally used in tech, SSPPU is increasingly relevant in life sciences as combination products become more common, suggesting a broader application for SSPPU-based royalty calculations in IP cases.
