To the co-chairs of the USPTO’s AI working group, the two main currencies of the IP ecosystem are creativity and trust. Where does trust in the USPTO come from? Its tens of thousands of experts, who apply judgment and discretion across domains and nuances each and every day. That’s why Jerry Ma and Charles Kim take a human-first approach to AI at the agency as it expands its internal use of AI from prior search to knowledge management and beyond. Figuring out how to empower their people to fulfill their roles with more clarity and information while leaving them “firmly in the driver’s seat” is their North Star. It’s a myth that Section 101 means you can’t get a patent, says the USPTO’s Director of Technology Center 3600 Tariq Hafiz. On last week’s episode, @Sri Atluri, Walmart’s Chief IP Counsel, worried about Section 101 uncertainty. That conversation had us thinking about our conversation with Tariq, who started overseeing the patent examinations of the business method art units shortly after the Alice decision. Tune in to hear his all of his advice to practitioners, such as: 1. Don’t avoid the business arts: its examiners are strong and know the law and 101 well, so they’ll help you craft strong patents 2. Write strong specs to help your examiner with their prior art search 3. Treat the interview as an opportunity to collaborate. Use technical terms when explaining your inventions — examiners are engineers. 4. Patent examiners have the same goal as you, to grant you a patent. That said, if you feel yours isn’t being fair, you can request additional reviews from the chain of command. 5. "We are a people-led, tech-powered omnichannel retailer helping people to save money and live better.” With tech baked right into Walmart's mission, Chief IP Counsel Sri Atluri thinks about IP protection first and foremost through the lens of its technologies. Do Walmart’s mobile app and checkout capabilities, for example, have the room they need to operate? Portfolio size is far down on her list of priorities because pursuing assets for the sake of it would conflict with Walmart’s EDLP, or Everyday Low Price promise, which isn’t just for its consumers. Last week, Qualcomm’s Ann Chaplin closed out her episode by emphasizing how licensing enables a “virtuous cycle of innovation,” which reminded us of our episode with Matteo Sabattini, Ph.D., MBA, from a year ago titled just that. To Qualcomm General Counsel Ann Cathcart Chaplin, the relationship between inside and outside counsel “really matters.” Here’s her advice to outside counsel on fostering trust and long-term relationships, from someone who’s been on both sides: - Give your client time to provide feedback. They are just as busy as you! - Tell your clients what you need. No matter how much your client tries, there will always be company information they haven’t fully conveyed. - Use the lines, “Are there things you want me to know in advance?” “What’s the most efficient way for me to get the information I need?” - Seek to understand your clients’ broader business in addition to the case. Sometimes winning the case isn’t the most important thing to their ecosystem. - Understand that as much as you care, in-house lawyers will inevitably feel more responsible for a case than you. Advance preparation and communication will help with handing over control. - Ask for feedback. Finishing a project is a great excuse to ask how you can be more helpful or what you can do differently. New to an in-house counsel role? Here’s General Counsel of Qualcomm Ann Cathcart Chaplin’s advice for gaining confidence: 1. Don’t just sit in your office, go out and get to know people. Ask for connections too. 2. Ask questions and for guidance. Everyone around you wants you to succeed, let them help. 3. It’s OK to not know everything, none of us do. And it’s OK to make mistakes. You didn’t get hired because you knew everything. You got hired because you’re smart and can learn. 4. Speak up! You’ve been hired for your judgment so it needs to be heard. Getting onboarded is a process that takes months. Show up and put in the work every day. 5.
