The Office of the US Trade Representative (USTR) is accepting requests for temporary exclusions from the Section 301 tariffs on certain China-origin goods. To facilitate these requests, a docket has been opened to allow for requests to be made online. These exclusions are available only for specific machinery listed under 312 select HTS subheadings. The list of subheadings was published in the Federal Register and can be found under Annex E. The list covers machines that are used in domestic manufacturing. Requests for exclusions must be submitted by March 31, 2025, and must identify the product by description and by the applicable 10-digit HTS code. The requestor should provide data to support the exclusion request. The USTR will evaluate the requests on a case-by-case basis. The East/Gulf Coast labor strike ended last week after three days with an agreement for a contract extension through January 15. The union and employers have agreed on wages, but the contentious issue of automation remains a sticking point. The industry will be watching developments closely in hopes that they reach an agreement and another strike or slowdown can be averted. The new deadline falls close to the start of the Lunar New Year holiday (January 29, 2025) that closes much of China and Asia manufacturing and is historically preceded by a surge of volume before the holiday closure. Ports impacted by last week’s strike are working through backlogs of vessels that had anchored offshore. Operations are running smoothly so far. Ocean carriers still have a variety of surcharges filed for October related to congestion, disruption, and emergency costs. Most of these are still going into effect as of this writing, though we could see a cancellation of charges if port operations remain relatively smooth. We are monitoring for updates. BREAKING NEWS: Multiple media outlets are reporting that U.S. East and Gulf Coast dockworkers have agreed to return to work, ending a three-day strike. In a joint statement, the International Longshoremen's Association (ILA) and United States Maritime Alliance (USMX) said they reached a tentative agreement on wages and will extend the prior contract, which expired October 1, through January 15, 2025. This understanding allows time for both sides to negotiate on other contentious issues, including port automation. CV International continues to monitor the situation closely and will provide updates on any significant developments as needed.
