With California rolling out new climate disclosure regulations, now’s the time for businesses to get ahead of the curve and ensure compliance. Here's how you can start preparing! But first, clarity! Clarity on California’s upcoming Regulations: California’s SB 253 (Climate Corporate Data Accountability Act): Requires companies with over $1 billion in revenue to report Scope 1, 2, and 3 GHG emissions with independent verification. Reporting frameworks like CDP are helpful first steps for tracking these emissions. Third-party verification of reported GHGs will be mandatory. California SB 261 (Greenhouse Gasses: Climate-Related Financial Risk Act): Mandates the disclosure of climate-related financial risks for companies with over $500 million in revenue, updated biennially. CDP and GRI can help meet these requirements by reporting risks and governance strategies. California SB 219: Updates SB 253 and SB 261, allowing for consolidated reporting at the parent company level and sets the timeline for Scope 3 emissions (2027). How Can You Get Ready? 1. Start collecting the necessary activity data to measure your Scope 1 (Direct) emissions, Scope 2, and Scope 3 (supply/value chain) emissions. 2. United Nations (UN) Convention on Biological Diversity (CBD) The 16th Conference of the Parties (COP16) to the Convention on Biological Diversity (CBD) will be held from October 21 to November 1, 2024, in Cali, Colombia. This significant global event, organized under the United Nations, will bring together governments, businesses, non-governmental organizations (NGOs), and indigenous groups to assess the progress of the Kunming-Montreal Global Biodiversity Framework (GBF), which was adopted at COP15. The main goal of the GBF is to halt and reverse biodiversity loss by 2030, including the protection of 30% of the world’s land and oceans. A key focus of COP16 for businesses is Target 15, which requires large transnational companies and financial institutions to disclose their impacts on biodiversity. This includes assessing how their operations, supply chains, and investments affect ecosystems. These disclosures are vital for promoting transparency and accountability, aligning business practices with global biodiversity goals. While SMEs in North and South America may not face direct regulatory pressure, they are likely to be indirectly affected as larger companies enforce sustainability demands throughout their supply chains. To stay competitive, SMEs will need to align with biodiversity-friendly practices. Additionally, COP16 will focus on mobilizing financial resources, including exploring biodiversity credit markets and innovative financing tools to make biodiversity conservation economically viable, especially in developing regions. Frameworks like the Taskforce on Nature-related Financial Disclosures (TNFD) will support companies in managing biodiversity risks and complying with growing regulatory demands, such as the EU’s Corporate Sustainability Reporting Directive (CSRD) and France’s Energy & Climate Law.
