Hey, fellow Title III fans – on Tuesday morning, F&R partner Amy Robertson will be arguing to the Ninth Circuit for a robust definition of “place of public accommodation,” to ensure the ADA’s antidiscrimination protections extend to all services of private businesses, whether provided on or off their physical premises. Amy along with co-counsel Michelle Uzeta of the Disability Rights Education and Defense Fund (DREDF) and Deborah Gettleman of McGuinness Law Group submitted an amicus brief on this subject, which you can read here: https://lnkd.in/g7524hXQ The case is Guthrey v. Alta California Regional Center. The argument starts at 9:00 Pacific Time tomorrow; you can watch here: https://lnkd.in/gZtYUHMY (select the link for the San Francisco Courtroom on Tuesday 8/13).

Excited to announce this excellent decision in our case against the Tennessee Department of Correction. Shout out to our team including Disability Rights Tennessee, Disability Rights Advocates, Disability Law United, paralegals extraordinaires Jordon Henderson and Sara Frederickson, and co-counsel emerita Martie Lafferty.
This week a federal judge ruled that the #Tennessee Department of Correction violated federal law by failing to provide sign language interpreters & videophones to #deaf #prisoners. More brilliance from Carrie Griffin Basas. Though I am not a disabled person, I found this passage resonated in the perhaps adjacent world of civil rights lawyers facing large, ignorant, hostile systems: <open quote> When you feel a fire rising within you, take a moment and ask yourself some questions: ● Is this smoky heap of ableism a good place to roast a marshmallow and make a s’more, instead? If so, grab some friends– preferably cross-movement, cross-disability– and just have a tasty snack. Talk strategy. Who else is impacted? Is this where we need to spend our time right now? Should I take this on so someone else doesn’t have to who has less privilege and energy than me right now? ● Do I have positional power to make a difference here? Don’t give yourself an easy out, either. You went to Harvard. You might not be the person in charge and you might feel vulnerable, but you could have less at stake than someone else who is just trying to survive a system. <close quote> https://lnkd.in/gQVZnred Image: Square black and white photo of Carrie outdoors wearing a dark demin jacket with a tiger face growling patch on the right, a patch of fist in a women’s symbol on the left, stud earring in one earlobe, other ear is covered by hair. Carrie has short hair above her shoulders, she’s looking at the camera and smiling. Background is blurry outdoor scene.

Our community lost a giant when Kevin Williams passed on Tuesday. We've been working with Kevin pretty much as long as Fox & Robertson has been around. He was our first client, our longtime co-counsel and co-conspirator, and dear friend. Though he leaves a large hole in our community, he also leaves a legacy of groundbreaking cases, powerful advocacy, hilarious storytelling, and deserving asses thoroughly kicked. Image: Kevin (white man; glasses; jaunty hat, short red beard) looking to the right of the frame, with a bemused expression, and, as always, preparing to talk. https://lnkd.in/gfsKjtmX

Grateful for Colorado doing the right thing - and for the badass advocates at Colorado Cross-Disability Coalition Disability Law Colorado Atlantis Community, Inc. ! 🎉🎉🎉
Today, on the final day of National Disability Employment Awareness Month, I am happy we closed an antiquated chapter in Colorado's history. All workers with disabilities in the state of Colorado now earn minimum wage or higher! Achieving minimum wage might seem like a low bar to most, but this was a long effort. About 10 years ago Julie Farrar clued me in to the legal practice of paying people with disabilities less than minimum wage by utilizing Section 14(c) of the Fair Labor Standards Act, at that time several thousand Coloradans with disabilities earned as little as a few cents per hour. Thanks to increased employment supports including benefits counseling from the Colorado Division of Vocational Rehabilitation in the Colorado Department of Labor and Employment, increased employment services and access to the Medicaid Buy-in for Working Adults with Disabilities for people with any type of disability by the Colorado Department of Health Care Policy & Financing - HCPF, and with support from Alliance (Colorado), the Colorado Developmental Disabilities Council, Atlantis Community, Inc. , Disability Law Colorado, Colorado Cross-Disability Coalition, and many others, the opportunity to work and earn real wages now exists for everyone. https://lnkd.in/gaJtCW8E

Fox & Robertson strongly urges the Senate to confirm Karla Gilbride as EEOC General Counsel. Karla would be phenomenal in this role. We've had the privilege of working with her on two Supreme Court amicus briefs and can testify to her brilliance and understanding of workers' rights and equal opportunity. #ConfirmKarla!
As a champion for worker’s rights and equal opportunity, EEOC General Counsel nominee Karla Gilbride would make an incredible addition. It’s time to #ConfirmKarla!
