Shortly after returning to Galloway Johnson Tompkins Burr & Smith, Associate Jonathon Austin secured a summary judgement win on behalf of our clients in a death injury case in Dallas. Jonathon originally joined Galloway in 2021, advocating for clients in our Houston office. Though he left the firm in late 2023, he discovered after a few months that the grass wasn't greener and that he missed working at Galloway. He came back to our team of result-driven litigators at came back to Galloway for the way we do things, our responsiveness, consistency, and the great personal and professional relationships at our firm. In July 2024, just a few months after resuming work at Galloway, Jonathon was granted summary judgment in our client's favor on our affirmative defense of statute of limitations. With the judgment granted for our client and all claims dismissed with prejudice, Jonathon and the Galloway team has again gone way above and way beyond in partnering with and defending our clients. Galloway Johnson Tompkins Burr & Smith successfully secured a favorable result in a rear-end trucking case in New Madrid County, Missouri, led by Director Jennifer Woulfe and Associate Allison Thompson serving as second chair. In this case, the Plaintiff's counsel asked for over $13 million but after a 40 minute deliberation, the jury awarded only $150,000. Jennifer and the Galloway team brought our experience, expertise, and tenacity for trucking and transportation defense cases, implementing key strategies before and during the contentious three-day trial. After the Plaintiff presented testimony from 3 experts as well as several family members, our team presented testimony from two experts. The Plaintiff asked the jury for $13,080,000 in damages, and the jury deliberated for only 40 minutes before returning a verdict that awarded a significantly less amount of $150,000. This result is tremendously positive for our clients, who trusted Jennifer, Allison, and our team to protect their business and to achieve their business objectives. Last week, our Tampa office hosted a thought-provoking and engaging event with ACC Tampa Bay - Association of Corporate Counsel at the Grand Hyatt Tampa Bay. The interesting presentation led to fantastic conversation among participants, which ended with a heated but friendly discussion on the Oxford comma. Our attorneys presented on recent case law changes to the coverage landscape, which covered the shift in judicial statutory construction from a previously more broad standard to textualism. They also discussed the history of statutory construction in Florida, the current requirements for judicial analysis under textualism, and case law examples of textualism at play over the past year.
