    Stakeholders need insight into broad thematic developments AND specifically relevant litigation to inform strategic decisions about project development. Litigation complexity makes project planning extremely challenging by injecting seemingly endless variables into the process, increasing uncertainty. These developments take resources to monitor and detailed expertise to interpet, which is why many #pipeline companies and #commoditiestrading teams rely on Arbo. Thanks to The Energy Council, who invited our Founder & CEO, Chip Moldenhauer, to lead a discussion of these regulatory and policy issues at a recent event in Houston.

    #FERC may need to consider altering its longstanding approach of relying primarily on precedent agreements to show market need after the DC Circuit found flaws in its market need analysis for Transco’s REA project. About 3/4 of the project’s capacity was subscribed to by 6 different local distribution companies and the rest by 2 gas marketers. This #pipeline project was heavily opposed and many of the official protests cited lack of market need. It is no secret that not all projects are opposed equally... But examining the 3 projects approved at the last Open Meeting reveals FERC’s market need analysis must vary in response to the unique characteristics of each project, region, shipper type, and subscription level — as seen in the chart below. All these projects are relatively small, received little opposition, and are located in states that have not historically been hostile to #naturalgas. We will be following closely to see if FERC enacts any broad policies related to market need considerations, or if it will continue making determinations on a case-by-case basis.

    A lawsuit filed by enviros concerned about the impact of O&G extraction on the GOM's protected marine life led the U.S. District Court for the District of Maryland to vacate the National Marine Fisheries Service's (NMFS) 2020 programmatic Biological Opinion on #GulfofMexico #oilandgas activities. The court originally set a deadline of December 20, 2024 for a new BioOp, which NMFS very compellingly demonstrated it could not meet. ❗ The court responded with a 5-month extension. ⏳

    Federal Court Does the Rare: Reconsiders and Changes Course on Gulf BiOp - Nice Work NMFS The Maryland District Court just did something federal courts rarely do - it reconsidered and altered its own judgment. For those who haven't been following - in August, the Maryland District Court vacated NMFS's 2020 Gulf of Mexico programmatic Biological Opinion due to concerns about protected marine species. The stakes are massive - this BiOp is the foundation for nearly 6,000 BSEE permits annually - everything from drilling permits to pipeline modifications to facility safety systems. It also underpins BOEM's permitting activities for 2,304 active leases in the Gulf. BOEM processes around 16 plans monthly, including Exploration Plans and Development Operations Coordination Documents, and faces a potential backlog of at least 80 plans during any gap. Without this BiOp, both agencies' permitting processes grind to a halt. What did the court do? It extended the effective date of its Gulf of Mexico programmatic BiOp vacatur from December 20, 2024 to May 21, 2025. Why is this a big deal beyond the obvious? Getting a federal court to change course after issuing a judgment, especially a strongly worded one, is extraordinarily difficult. But NMFS managed to demonstrate so effectively what was at stake that the court granted the extension, avoiding what could have been a devastating regulatory gap for Gulf operations. This is a significant win. The agency's detailed filings clearly showed why the original deadline wasn't just challenging - it was impossible. The new timeline, with required 60-day status reports, offers a practical path forward. Tip of the hat to the NMFS legal team, nice work. The holiday season just got a little brighter for you all.     Thx to The Energy Council for organizing a day of interesting panel discussions. Arbo's Chip Moldenhauer led thought leaders from Morgan Stanley Energy Partners, Equinor, and Westlawn in a discussion of regulatory and policy threats to the industry's rights to operate. If we’re going to power up this country with a more reliable and cleaner energy grid, then we need to get back to building... which has been made increasingly difficult by permitting, policy and litigation landmines.
