New Online in HILJ x Harvard International Arbitration Law Students Association (HIALSA): Galo Martín M. critiques the damages award in Eiser v. Spain, a recent international investment arbitration arising from Spain's decision to retract renewable energy investment incentives. "States should only be liable for the portion of damages attributable to the difference between the injury caused by the measure actually imposed, and the hypothetical injury that would have been caused by a lawful alternative measure," Galo Márquez explains. https://lnkd.in/eFpSc4kK
