A Win for Property Rights in South Dakota Our firm applauds South Dakota for recently passing legislation to end home equity theft in the state. Governor Kristi Noem signed House Bill 1090 into law, requiring governments to auction tax-foreclosed properties within one year and return excess proceeds to the original owner. This new law aligns with the U.S. Supreme Court's unanimous Tyler v. Hennepin County decision, which we have discussed in the past, and which ruled that retaining equity from tax-foreclosed homes is unconstitutional. While South Dakota now protects its citizens' property rights, eighteen states still allow equity theft, harming homeowners and exposing governments to legal liability. We can only hope more states follow South Dakota's lead in establishing fair protections that balance individual property rights, tax collection, and the greater good. Getting this balance right matters for homeowners, communities, and the rule of law. #propertyrights #realestatelaw #taxlaw
