Wage and hour claims have seen a steady increase in the past several years thanks to aggressive plaintiffs’ lawyers and zealous government agencies. Few types of litigation present stakes as high as wage and hour matters, as these claims are frequently raised on a class-wide basis and can provide for damages, penalties, and attorneys’ fees. That's why In-House Connect was so fortunate to organize a CLE webinar on the Top 10 Wage and Hour Mistakes for Employers, hosted by labor and employment thought leaders Amanda Fugazy and Steven Nevolis of Ellenoff Grossman & Schole LLP! Amanda and Steven led an engaging and interaction session, detailing the most common wage & hour mistakes that employers make. Here are the top five takeaways from the program: 1. Separation Agreements and Final Pay: It's crucial for employers to ensure employees are paid all entitlements before separation and to include essential provisions like arbitration and release clauses in separation agreements. This helps mitigate legal risks and ensures compliance with wage obligations. 2. Overtime Compensation and Payroll Compliance: Employers need to adhere strictly to federal and state regulations regarding overtime compensation, ensuring that non-exempt employees are properly compensated for all hours worked over 40 per week. Accurate record-keeping and audit practices help in avoiding liabilities and ensuring compliance. 3. Proper Classification of Employees and Contractors: Misclassification of employees as independent contractors can lead to significant legal repercussions. The correct classification hinges on various factors such as control over work, nature of tasks, and compliance with salary and duties standards. Clear agreements and engagement with legal counsel are essential. 4. Timekeeping and Record Maintenance: Effective timekeeping systems are crucial for tracking employee hours accurately, especially for remote workers. Employers must maintain meticulous records for at least six years and ensure that all hours worked between the first and last principal activities are compensated. 5. Manager Training and Payroll System Integration: Training managers on employment issues and best payroll practices is vital since they are the first line of defense in handling day-to-day issues. Ensuring that payroll systems are efficient and capable of handling complexities like time clocks, geo-tracking, and system failures can preempt many legal challenges.
