Based on this report from The Cicero Institute: 3 states (NM, KS, AR) specifically restrict async mode to start a provider-patient relationship; 15 states (WA, OR, UT, AK, ND, MN, LA, MS, AL, SC, WV, VA, NJ, VT, RI) suggest certain requirements that would not allow a Telehealth modality, including async mode; All other states allow any Telehealth modality including async mode as long as the standard of care can be met.
