Keller and Heckman LLP Partner Katie Bond and Associate Samuel Butler authored a Washington Legal Foundation (WLF) Legal Pulse article, “Not an Erratum: Ninth Circuit Court Repudiates WLF Legal Pulse Post with Preemption Ruling.” The article follows up on a previous blog post by Katie and Samuel after the Ninth Circuit issued a ruling in an FDCA preemption case, Davidson v. Sprout Foods, Inc. “In a 2–1 decision authored by Judge Schroeder, the Ninth Circuit said that the FDCA does not preempt plaintiffs from prosecuting a case based on the Sherman Law’s incorporation of the FDCA’s food labeling requirements,” noted Katie and Samuel. They then emphasized Judge Collins’ dissent on this point, indicating that he argued “that a plaintiff cannot sue based on allegations that conduct violates the FDCA, even if those allegations are recast as allegations that conduct violates the Sherman Act.” View more details, including a link to the full article below. https://lnkd.in/e48-AmuW

On June 18, 2024, the California Attorney General and Los Angeles City Attorney announced a significant $500,000 settlement with Tilting Point Media LLC for violations of the California Consumer Privacy Act (CCPA), Children’s Online Privacy Protection Act (COPPA), and California Unfair Competition Law (UCL). The violations involved the collection and processing of children's personal information without consent and inappropriate advertising to children. The investigation, initiated by the Children’s Advertising Review Unit (CARU) in September 2022, revealed that Tilting Point failed to provide effective age screening and obtain verifiable parental consent, among other breaches. In addition to paying $500,000 in civil penalties, Tilting Point must take several corrective actions, including ensuring all games directed to children comply with the CCPA and COPPA, enhancing their age screening mechanisms and privacy policies, configuring third-party SDKs, and conducting annual compliance assessments. The Shanghai team at Keller and Heckman LLP reports on the latest developments in food labeling regulations as two agencies release drafts of new requirements. On June 27, 2024, China’s National Health Commission (NHC) published a draft of the Food Safety National Standard for the Labeling of Prepackaged Foods (GB 7718-xxxx). The next day, the State Administration of Market Regulation (SAMR) released draft amendments to its Measures for Supervision and Administration of Food Labeling. These key documents address significant changes in food labeling, resulting from years of coordination between NHC and SAMR to streamline responsibilities and optimize label management.
