In order to stay on top of the rapidly evolving #esg legal landscape, earlier this week I attended the second annual Legal ESG Summit in New York, and it was packed with insights! A few key takeaways that stood out: - #Greenwashing litigation is on the rise – companies are being held accountable on consumer fraud, securities, climate change, and social justice claims. - Several U.S. states are enacting anti-ESG legislation and executive actions, creating a more challenging compliance environment for companies seeking to balance with their corporate existing commitments and initiatives. - Some companies are resetting ambitious targets with goals that are more practical, achievable, and material to their business operations to increase their credibility and to mitigate risk of greenwashing allegations and lawsuits. - As the regulatory landscape evolves, many companies are spending significantly more on compliance than sustainability innovation. While automation and data integration will help companies bring down reporting costs in the long-term, companies are rethinking how reporting data is used internally to drive an ROI for their efforts. - The impact of EU’s #CSRD is already being felt by U.S. companies, with sustainability teams dedicating more time and budget to meet this and other European reporting obligations that span annual ESG reporting, double materiality, supply chain due diligence, as well as green claims.
