In her latest article for The Legal Intelligencer, Christina Horton Duty explores new rules for the implementation of the Mental Health and Parity Addiction Equity Act (MHPAEA). Key provisions include: → Design and Application Requirement: Health plans must ensure that Non-Quantitative Treatment Limits (NQTLs) for mental health and substance use disorder benefits are comparable to those for medical/surgical benefits in terms of design and applications → Relevant Data Evaluation: Plans must collect and analyze data to assess the impact of NQTLs on access to mental health and substance use disorder benefits compared to medical/surgical benefits → Comparative Analyses: Health plans are required to conduct comparative analyses to measure the impact of NQTLs → Sunset of Opt-Out Provision: The provision allowing self-funded nonfederal governmental plans to opt out of MHPAEA compliance is being eliminated Healthcare providers should know that the final rules generally take effect on the first day of the first plan year beginning on or after January 1, 2025.
