The ABA has released its first formal opinion on the use of generative AI. Key takeaways are listed below. I strongly recommend that all attorneys read this opinion in conjunction with the CA state bar's practical guidance on AI: * Duties of Competence -- AI is not a stand-in for professional judgment, but there may come a time when use of AI is expected to provide competent advice. * Confidentiality -- Will AI protect data, even from individuals within the firm who should not have access to client confidences? * Communication -- AI transparency to clients. * Candor to the tribunal -- Lawyers should not make misrepresentations to the court and correct for prior inaccuracies and misstatements caused by GAI. * Supervision of Lawyers and Non-Lawyers -- Managerial attorneys are responsible for the use of GAI by attorneys and non-lawyers at the firm. * Fees --- Lawyers cannot up-charge on direct costs and reasonable allocations of expenses, absent a written agreement. This is a great quote: "While GAI may be used as a springboard or foundation for legal work—for example, by generating an analysis on which a lawyer bases legal advice, or by generating a draft from which a lawyer produces a legal document—lawyers may not abdicate their responsibilities by relying solely on a GAI tool to perform tasks that call for the exercise of professional judgment." #lawyerethics #professionalresponsibility #AI #stayingaheadofthecurvebutnottooahead

Last Friday, Colorado Governor Jared Polis signed the country's first state comprehensive AI bill into law --- but with hesitation. In an unusual turn, he explicitly calls for a federal bill to preempt Colorado's law before it takes effect. As noted in the signing statement below, "the important work of protecting consumers from discrimination and other unintended consequences of nascent Al technologies is better considered and applied by the federal government to limit and preempt varied compliance burdens on innovators and ensure a level playing field across states along with ensuring access to life-saving and money-saving Al technologies for consumers."
