In the recent case of 𝘊𝘩𝘦𝘱𝘪𝘭𝘬𝘰 𝘷. 𝘏𝘦𝘯𝘳𝘺, Magistrate Judge Stewart D. Aaron emphasized the importance of preserving 𝗰𝗮𝗺𝗲𝗿𝗮 𝗳𝗼𝗼𝘁𝗮𝗴𝗲 when litigation is 𝗿𝗲𝗮𝘀𝗼𝗻𝗮𝗯𝗹𝘆 anticipated. Failure to maintain such evidence can lead to Rule 37 consequences. This ruling serves as a reminder for organizations to implement robust legal hold procedures, ensuring all potentially relevant information, including video recordings, is preserved to prevent evidence spoliation. "There are no bright line rules about when one should reasonably anticipate litigation, and the standard can be subjective." Read more from Kathryn C. 💡 “Two plus two is not five. It is not six. It is four.” 💡 Some conversations stay with you long after they’re over. This was one of them. Dr. Maura R. Grossman is not just a leading voice in eDiscovery — she’s a visionary who fundamentally changed the field. Her pioneering work in Technology-Assisted Review (TAR) and Continuous Active Learning (CAL) reshaped how we approach legal technology, setting the stage for everything that followed. Her writings helped shape my knowledge of this industry. It was an absolute honor for me and my co-host Brandon Mack to sit down with Dr. Grossman on the National eDiscovery Leadership Institute NeLIPod Podcast to talk about the past, present, and future of AI in legal tech. From the pushback against TAR to the blind rush into Gen AI, we explored the mistakes of the past and the challenges ahead. This is an episode to remember! 🔹 Why did TAR face resistance while Gen AI is being embraced so quickly? 🔹 Are courts misunderstanding AI the way they misapplied TAR statistics? 🔹 Is the legal industry repeating history with new tools—or actually evolving? Dr. Grossman doesn’t hold back. And her insights in this episode are essential listening for anyone who cares about the future of legal technology. 🎧 Listen here: Apple: https://lnkd.in/guHxFXa9 Spotify: https://lnkd.in/gGmwiU5n NeLI Website: https://lnkd.in/ggnAeVjH Dr. Grossman, thank you for your time, your brilliance, and your dedication to shaping this field.
