“She was told ‘he’ll get better, he’ll be fine,’” said NYSTLA officer Joseph Ciaccio, the attorney representing the McManus family. “Until finally on November 30, 2022, she brought him back to Albany Medical Center to the emergency room, where they remained there for 17 hours. As his condition continued to deteriorate, her panic grew, but she was not able to get any help. Later that night, after 17 hours, he went into cardiac arrest, he coded and died.” The McManus family is using this tragic loss to push Governor Hochul to sign legislation that is aimed at offering greater protection and justice for families facing similar tragedies. Because in New York State, accountability for wrongful deaths only goes so far. “Under New York’s law that still exists, and we’re one of only two states that still have a law like this, those types of damages or compensation is limited to a person’s economic value,” said Ciacco. Essentially, wrongful death lawsuits value an individual solely on how much money they make. In Micah’s case, even if the court finds the hospital at fault for his death, his parents won’t get much in pecuniary damages since the three-year old doesn’t earn income. The Grieving Families Act aims to reform the state’s old law. The bill’s sponsor in the Senate, Senator Brad Hoylman-Sigal (D) says the bill would allow families like the McManus’ to seek compensation not just for financial losses but emotional damages. “If a deceased individual is not the breadwinner of the family, if they’re very young, if they’re older, have a disability, often times if they’re a woman or person of color, or work in a low wage job or may have a lower educational status, that means that necessarily they are devalued under New York’s wrongful death statute,” said Hoylman-Sigal.
