Now more than ever, influencers, bloggers, and content creators are being used to advertise a third party’s goods and services. But, is that considered "retail services" as defined by the US Patent and Trademark Office? That questions were recently raised in front of the Trademark Trial and Appeal Board, which ruled that an influencer who merely provides links that allow their followers to purchase products via a third-party website did not constitute “retail services” for the purposes of obtaining a trademark registration. The Federal Trade Commission announced a final rule with major changes to the information and documents required for premerger notification under the Hart-Scott-Rodino (HSR) Act. The rule requires a variety of new or additional information and documents about the parties to, and the rationale for, reportable deals.
