Virginia has expanded its ban on noncompete agreements for low-wage employees to include all workers entitled to overtime pay under the Fair Labor Standards Act. Beginning July 1, 2025, employers cannot enter into new noncompete agreements or renew existing noncompete agreements with these employees. In a recent ruling, the German Federal Labor Court invalidated certain expiration clauses regarding the forfeiture of vested option rights upon termination of the employment agreement within the vesting period. We discuss whether it is likely that, in the wake of that ruling, German courts will also invalidate bad leaver event-related clauses concerning MEP participations and outline relevant measures to minimize such risk. Federal and state legislators are debating new efforts to pass privacy laws that regulate the collection and processing of individual personal data by companies. Congress is likely to reintroduce the Kids Online Safety Act, which passed the U.S. Senate last year but never received a vote in the U.S. House. Almost 40 states are considering either comprehensive privacy legislation or bills that focus on children's privacy, the collection of biometric data and/or the collection of health data.
