Yesterday's news release from the IRS about the Employee Retention Credit (ERC) tells us so much about what's happening in the current ERC landscape. The moratorium has given the IRS time to catch up on claims and they are now sending 20,000 disallowance notices to companies that either didn't actually exist or didn't have employees: a newsworthy accomplishment for them. While some unscrupulous promoters have actively encouraged those sorts of claims, these "companies" wouldn't make it past the first minute of a call with our consultants (let alone the Top 100 law firms we partner with). Pinecrest's ERC clients are sleeping well.
