For those of us at the intersection of AI and the creator economy, one question frequently arises: What constitutes Fair Use for AI model training? Why is this such a hot topic? Think of AI as a box of complex math powered by big data. The internet, with its vast pool of information, is AI’s liquid gold, leading many AI companies to scrape data and partner with media outlets to access broad content pools. However, the definition of fair use in this context is highly debated. Let’s assume this is the reason why so many are engaging with reporter @Kit Eaton’s latest report in Inc. Magazine, which highlights an interesting perspective from Mustafa Suleyman, co-founder of Google's DeepMind and now CEO of AI at Microsoft. Suleyman’s thinking is that anything on the internet should be fair game for AI training. A bold statement when considering the complexities behind determining fair use and protecting copyright of creators. For those unfamiliar, there is a test used by the US courts to determine fair use, which looks at four factors: 1️⃣ the purpose and character of the use 2️⃣ the nature of the copyrighted work 3️⃣ the amount and substantiality of the portion taken 4️⃣ the effect of the use on the potential market. These tests are gray and ambiguous. Unless the AI is being used for education, criticism, or research, asserting fair use for a profit-first enterprise is, in my opinion, going to be a long stretch. At this point, Google and Microsoft are some of the only technology companies drawing lines in the sand on this issue, but to get the best answer for all we need other technology companies and executives to chime in on this topic. The rise of AI in the creative sector has sparked significant concern among creatives about job displacement. OpenAI CTO Mira Murati, in a talk at Thayer School of Engineering at Dartmouth, acknowledged this concern, pointing out that some repetitive creative jobs may disappear (check out the full fireside chat here: https://lnkd.in/g7jwKkuT). Her points come at a time when new data from The Wall Street Journal found a decline of up to 21% in freelance job postings on platforms like Upwork and Fiverr, especially in roles such as writing, coding, and translation. This data suggests that AI has already begun displacing some jobs in the broader labor market. However, I believe this job displacement is a short-term effect, especially in the creative industries. In the long term, AI will provide creators with more opportunities and create new jobs that don’t currently exist. For example, AI can expand our intelligence, creativity, and imagination, offering unprecedented chances to innovate and connect with audiences. By generating ideas, streamlining processes, and reducing barriers, AI will enable the creation of more compelling content in ways we at RAD AI can't even imagine. When I read Sydney Lake’s reporting on Murati’s comments, it's important to remember that there are two lenses when looking at the impact of AI: the short term and the long term. Apple's decision to extend its AI feature rollout into 2025, announced at WWDC 2024, caught my eye (as a fellow AI enthusiast). This focus on quality and user experience over a rushed release is a great sign for the responsible development of AI, and a commendable move by arguably one of the biggest names in the industry today. Of course, it goes without saying that by taking the time to refine these features, Apple minimizes the risk of glitches and ensures a smooth(er) user experience. Such a meticulous approach could help to  foster trust, which is crucial for AI adoption across all industries, including ours – the world of influencer marketing. In our fast-paced world, prioritizing stability alongside innovation is a breath of fresh air. Apple reminds us that reliable, user-centric AI is what paves the way for long-term success. Why are we at RAD AI paying attention? Well, the success of influencer marketing hinges on trust – both between brands and creators, and between creators and their audiences.
