Robinson+Cole Education Industry Team chair Kate Dion and member Sabrina Galli co-authored an article for BusinessWest discussing the confusion about the enforceability of new Title IX regulations, resulting from litigation in federal courts that have issued preliminary injunctions barring enforcement throughout the country. As of now, the 2024 regulations are enjoined from being enforced in nearly 26 states. While the litigations play out in due course, institutions in affected states will want to be on the lookout for any changes to these preliminary injunctions, and consider whether any state laws weigh into their consideration to amend their policies consistent with the new regulations. https://bit.ly/4e6YIw8 #TitleIX #educationlaw #compliance #highereducation

Robinson+Cole’s Abby Warren and Jessica Pinto recently co-authored an article for Modern Restaurant Management (MRM) magazine reviewing the Department of Labor’s April 2024 rule that significantly increases the salary threshold for exempt employees, with the next scheduled increase slated for January 1, 2025. The authors suggest that before the January deadline, restaurant industry employers may want to review their exemptions to ensure each position that has been classified as exempt passes the requisite legal tests, including both the salary and duties tests, in light of the DOL’s rule. https://lnkd.in/egv9emSH #exemptclassification #employmentlaw #restaurantindustry #restaurantmanagement
