🏆 A huge congratulations to our exceptional attorney, Dayana Hernandez, Esq., for securing not one, but TWO case dismissals this week! Her sharp legal insight and relentless dedication delivered powerhouse wins for our clients. ✅ The First Victory: Our Motion to Dismiss led to a resounding win by exposing the Plaintiff’s clear failure to comply with the Notice of Intent to Litigate provisions under Florida Statute §627.70152—a critical procedural requirement in property insurance litigation. The Plaintiff’s Notice of Intent to Litigate was fatally flawed, lacking the insured’s email address and failing to confirm that the Notice was provided to the insured. This oversight rendered the notice non-compliant with the law. Remarkably, Dayana's clear and sound legal arguments led Opposing Counsel to voluntarily dismiss the suit without the need for a hearing, recognizing the strength of our position.   ✅ The Second Victory: In another instance of the Plaintiff’s failure to comply with Florida Statute §627.70152, our Motion to Dismiss resulted in a decisive win for our client. After our client issued a coverage determination based on the reported damages, the Plaintiff later filed a Notice of Intent to Litigate, including an expanded estimate for a full roof replacement and additional repairs—submitted after the coverage determination. Under the statute, this estimate acted as a supplemental claim, ensuring that the carrier had 90 days to further investigate and issue a supplemental coverage determination. Despite this, the Plaintiff filed a Notice of Intent without allowing our client the required time to respond. Dayana filed a Motion to Dismiss, and although the judge initially reserved ruling and requested competing orders, the case was ultimately dismissed due to the Plaintiff’s non-compliance. We learned, we won, we lost, we gained, and with these 5 years, we have created a tiny universe filled with teammates who give their everything, everyday, who show up, and show off, and use their immaculate brain power to win and be victorious, to hold up and support their teams, and do with joy and decency, and goodness in their minds and hearts. In 1971, at the order of Rep. Bella Abzug, Congress designated August 26 as Women’s Equality Day to honor the certification of the 19th Amendment in 1920, which granted women the right to vote. SBLL July Spotlight features shareholder, Donald Lavigne! This month we asked Donald S. Lavigne to give insight on what he would tell his younger self based on what he knows today. Donald shed light on the experiences life has brought him and how they have taught him invaluable lessons on impermanence and being present in those moments. His words are nothing short if inspiring and gave us all a glimpse into how having a positive mindset, can shift our perspective on the challenges we face. Read Donald's response below! "Well, don’t we all wish this on some level. I will assume that I don’t have much time with my younger self, so I would probably say something like this: Life often feels like it stretches endlessly when you're young, and it's easy to overlook the importance of small wins, losses and sometimes ties. You might think that there will always be more opportunities and that future moments will hold greater significance. Its easy to think: "I will just learn that later, fix that later, deal with that later"….it feels like you have endless time. But that's a misunderstanding. Every experience—whether it’s a victory, a defeat, a triumph, or a disappointment—plays a crucial role in the journey. In fact, that is the journey. That is the true magic. The day to day. One key truth I've learned is that both good times and bad times are fleeting (and I am borrowing this from Mr. Tom Hanks). When things are going well, remember that this too shall pass, and appreciate it fully while it lasts. On the other end, when you're facing challenges and it feels like things will never improve, remember that this too shall also pass. Both phases are temporary, and their impermanence is a reminder to seize and value each moment. As you enjoy success or stare down adversity, it’s vital to cherish and engage with each experience. Learn from the tough days, enjoy the good ones, and stay diligent even when the days seem routine. These moments—though they may seem ordinary or transient—are where the real magic happens and where the foundation for future opportunities is built. This month, we asked Paloma, “If you could go back in time, what advice would you give your younger self?” Her response below, was nothing short of profound. “My mother has been the most influential in my life and has had such an impact on who I am. Because of her I’d tell my younger self that no matter how hard the challenge is, take the risk. Everything you put in your mind can happen and rejection is sometimes a redirection but keep moving forward. Be more curious to learn about the world, the need to “lean into” situations and environments that are uncomfortable will enable you to grow, learn and overcome.
