If you work in sales tax, you're likely familiar with the True Object Test. Sales Tax Nerds are talking about the True Object Test because of CheckFree's refund case in Ohio. CheckFree made a refund application for over $2 million based on payment authorization and bill payment services being non-taxable in Ohio. Ohio's Department of Taxation denied this refund application, and the Commissioner upheld that decision. What was the reasoning behind this decision? Is your Halloween costume taxable? The answer is trickier than you think. Seven states provide exemptions for clothing, but it's not that simple. Here are a couple of examples: Tennessee- children's novelty costumes are exempt during Tennesee's annual sales tax holiday. Texas- children's novelty costumes are exempt. New York- clothing and footwear sold for less than $110 per item or pair are exempt, however, anything very obviously sold as a Halloween costume is taxable. Minnesota- "all human wearing apparel suitable for general use" is exempt, including costumes! Additional accessories are taxable. What are you going as this Halloween?
