About us

The Transatlantic Lawyer® is a full-service corporate, regulatory and transactional boutique firm dedicated to supporting companies in their international operations. We assist our clients in all stages of their development, from setting up their corporate presence to drafting or localizing contracts, t&c’s, terms of use, or company policies for use in the U.S., Canada and Europe, and we assist our clients in negotiating their contracts with local prospects and clients. We serve as acting General Counsel to a number of small and medium size companies that require dedicated, in-house legal management and resources, but are not yet large enough to justify hiring a full-time in-house counsel. We provide our services in support of established in-house legal departments which need temporary additional resources on a part time basis to support their operations. We also act as outside Data Protection Officers (DPO) for a number of our clients, managing their compliance with U.S. and international privacy laws, drafting various privacy-related documentation (e.g., HR privacy policies, data security, incident response/data breach, data retention policies, registers of processing activities, privacy impact assessments, privacy policies and other notices, cookies notices, DPAs and other international data transfer agreements, incl. EU standard contractual clauses (SCCs) and UK International Data Transfer Agreements). In either of the above capacities, our 30 years of professional experience, including 15 years as an in-house legal and privacy counsel in the EU and the U.S., together with our ability to draft/negotiate agreements and provide legal and privacy expertise under U.S., Canadian and European laws is a strong asset.

  • 🌐 Website hosting providers are subject to different liabilities in France and the U.S. In France, hosting providers must follow strict guidelines for monitoring content and reporting illegal activities under the EU's e-Commerce Directive. Meanwhile, in the U.S., protections like Section 230 of the Communications Decency Act offer much more freedom for hosting providers, with less liability for user-generated content. Understanding these differences is critical for any business hosting data or websites across borders. Missteps can lead to legal challenges that could have been easily avoided. Explore our detailed comparison of these legal frameworks and see how you can stay on the right side of the law in both jurisdictions. https://lnkd.in/eU7NMMEF #WebHosting #LegalLiabilities #FranceVsUS #eCommerceDirective #Section230
