Shook Partners Pat Kenney and Mark Hegarty and Associates Emily Pedersen, Mary Kate Throckmorton, Daniel Cummings and Colin Murphy championed food security for homeless people when a city hot breakfast program faced claims alleging the service was a common law and statutory nuisance. Shook was asked to help when a group of companies across the street sued the program earlier this year. Shook’s attorneys stepped in to shed light on the plaintiffs' claims, which proved to be overreaching and largely baseless on the behavior of the people receiving the hot breakfast service. After a three-day evidentiary hearing, the plaintiffs' motion for a preliminary injunction was denied, preventing the program from being shut down. A federal court in New York has held that employees engaged in manual labor have a private right of action under New York Labor Law for the untimely payment of earned salary.
