I've been receiving questions from employers and candidates alike. Are non-competes enforceable after the new FTC ruling? Here's a quick update. Texas Court Blocks FTC Non-Compete Ban! On August 20, 2024, the U.S. District Court for the Northern District of Texas permanently blocked the Federal Trade Commission's (FTC) nationwide ban on non-compete agreements. This ruling followed a preliminary injunction that had previously indicated the court's likely stance, though initially, the injunction only applied to the plaintiffs involved. The court's opinion emphasized that the FTC overstepped its statutory authority with this rule, labeling it as arbitrary and capricious. Notably, the judge extended the relief beyond the initial plaintiffs, setting aside the FTC’s non-compete rule in its entirety under the Administrative Procedures Act. While the FTC is contemplating an appeal to the Fifth Circuit, the immediate impact is clear: the FTC’s non-compete rule will not take effect as scheduled on September 4, 2024. However, the debate surrounding non-compete agreements remains active. The FTC still holds the authority to challenge such agreements on a case-by-case basis under federal competition law. Additionally, state-level actions are significant, with four states outright banning non-competes and 33 states plus Washington, D.C. imposing restrictions on their use. In many cases, non-compete agreements tied to the sale of a business continue to be enforceable, provided they meet standards of reasonableness. This ruling is a crucial development for employers and employees alike, signaling ongoing legal complexities in the landscape of non-compete agreements. Note: This is not legal advice.
