Since 1965, Terracon has evolved into a successful multi-discipline firm specializing in environmental, facilities, geotechnical, and materials services.   • There’s a jurisdictional change for Waters of the United States (WOTUS) after a recent field memorandum issued by the U.S. Environmental Protection Agency. In short, wetlands would now need to be physically abutting jurisdictional water to be considered jurisdictional “adjacent wetlands”. Wetlands connected to jurisdictional waters by a non-jurisdictional ditch, swale, or other distinct conveyance may no longer considered jurisdictional. This change doesn’t affect state and/or local regulations, which would still apply. Our national WOTUS team has monitored ongoing WOTUS rule changes since before the 2023 Sackett v. EPA Supreme Court decision that set updated regulations in motion.
